Vodafone Pay as you go Mobile Telecommunications Service General Terms

Definitions

The following words and expressions have the following meanings:

• “3G Session” means an internet session established using 3G technology;
• "Account" means the Customer's Vodafone pay as you go mobile telephony account;
• "Call" means a transmission made over a telecommunications network for the purpose of communicating a voice or data message (which includes, without limitation, short text messages, multi-media messages and calls to WAP services);
• "Call Content" means the content of any voice or data Call received or made by a Customer over the Network;
• "Charges" means the charges for the Service as published in Vodafone’s periodically updated tariff guides including, but not limited to, service options, tariff charges, Call charges (which may vary depending on the type of Call made), GPRS Connection charges and administrative charges) and certain Third Party Services which the Customer may choose to receive;
• "Customer" means the customer who is connected to the Network by Vodafone;
• "Equipment" means the Customer’s type approved mobile terminal and the Vodafone SIM card which is connected by Vodafone to the Network pursuant to this Contract;
• “GPRS Session” means a WAP or internet session established using GPRS technology;
• “Minimum Period” means such period specified on the Customer Application Form or in the absence of any period therefore 12 months commencing on the date of the Customer’s connection to the Network;
• "Network" means the mobile telecommunications network and systems used to provide the Service;
• "Service" means the pay as you go mobile telephony service provided by Vodafone, which enables the Customer to make or receive Calls over the Network and any additional services provided by Vodafone over the Network from time to time;
• "the Territory" means Ireland (excluding Northern Ireland);
• "Third Party Service" means any service promoted or provided by third parties to the Customer over the Network;
• "Vodafone" means Vodafone Ireland Limited whose registered office is at Mountain View, Leopardstown, Dublin 18;
• "Vodafone Agent" means any person authorised to promote and sell the Service or carry out business activities on Vodafone’s behalf.

1. How are the T&Cs structured?
   1. When signing up to mobile telecommunications services from Vodafone Ireland Limited (a company registered in Ireland having its registered office at MountainView, Leopardstown, Dublin 18) you will be required to accept these General Terms and Conditions as well as Service specific terms and conditions which relate specifically to the services chosen by you.    2. These Terms and Conditions and the terms and conditions of any applicable Service options or promotions constitute a legally binding contract (the "Contract") between you and Vodafone. This Contract shall commence when Vodafone connects you to the Vodafone telecommunications network. Please note that various related Vodafone products and services and third party services may be subject to additional terms and conditions which you are advised to read.
   3. Vodafone reserves the right to alter any terms of this Contract for legal, technical, operational or commercial reasons, or to terminate any package or change its tariffs, on giving you thirty (30) days’ notice. In the event of any such alteration, you shall have the option to terminate the Service without penalty during the notice period, subject to payment by you of all Charges due to date. Please note that Vodafone agents are not authorised to amend this Contract or to agree any provision which is inconsistent herewith. Your continued use of the service signifies your acceptance of any amendment.
   4. This Contract is personal to you. You shall not assign or otherwise transfer the Contract in whole or in part. Vodafone may freely transfer this Contract without notice.
2. What services can you expect and are there any service restrictions?
   1. Depending on the capability of your equipment you may be able to make or receive call/texts or transmit data over the Vodafone network from time to time.
   2. Due to the nature of mobile services Vodafone is not in a position to guarantee or offer any minimum service levels. The quality and the availability of the Service and related Vodafone products and services is subject to certain limitations, including the proximity of base stations and circumstances beyond Vodafone’s reasonable control including, but not limited to, geographic and atmospheric conditions and the functional capability of your equipment. Vodafone does not represent or warrant that the operation of the Service or related Vodafone products and services will be uninterrupted, timely, secure or error-free or that it will meet your specific requirements. In particular Vodafone does not represent or warrant that calls will not be dropped, 3G or GPRS sessions will not be lost, transmission of data calls shall occur at any particular speed or that all traffic can or will be transmitted by the network. Vodafone does not accept responsibility for the security of 3G or GPRS Sessions. You conduct any 3G or GPRS session at your own risk and is solely responsible for adopting such appropriate security measures against unauthorised access to and interference with equipment (or associated software/hardware and data) as may be necessary.
   3. Vodafone may modify or suspend the service wholly or partially, with or without notice, if such action is deemed necessary by Vodafone (e.g. for maintenance, security or other valid reasons) or if Vodafone is requested by an authorised authority or required to do so by legislation or for technical, maintenance, security or other valid reasons. All reasonable efforts shall be made to minimise such service disruptions. You shall remain liable for all charges during any such service disruptions unless Vodafone decides otherwise.
   4. Vodafone reserves the right, without prejudice to any other provisions of this Contract, to issue such reasonable instructions concerning the use of the service as may be necessary in the interests of safety, quality of service, other customers or telecommunications services as a whole, or for any other valid reason Vodafone deems sufficient.
   5. You may not make certain types of Calls using the Equipment. Please refer to Vodafone’s Customer Guide for details. In particular you should note that international calls and calls to premium numbers will not be permitted when a customer first subscribes to services from Vodafone. If you wish to have access to such additional services you should contact Vodafone’s customer care in order to lift the bar.
   6. All incoming voice calls which are not answered or which are received when the equipment is busy, switched off or out of coverage will be automatically diverted to the Vodafone voicemail service and this functionality may not be altered.
   7. Vodafone makes no representation and gives no warranty as to the content, quality, availability, suitability or timeliness of any third party service. Vodafone reserves the right to suspend or withdraw access to all or any such third party services on a temporary or permanent basis at any time. Your use of such third party services is at your sole risk and Vodafone shall not be responsible or liable for any loss or damage suffered arising from the use of such services. Vodafone may be required to charge you for such services.
   8. Vodafone continuously monitors network performance to ensure that the service received by customers is not impacted through a minority of users placing high demand on network resources (e.g. large bandwidths over long periods or exceptionally high call volumes). Any such high-demand users can expect to experience reduced speeds at peak times .Peak times are subject to ongoing change based on actual network demands. This service does not support ‘calls over the internet' or data sharing. If you want to use data services like making calls over the internet or sharing data files over the internet you should choose a tailored data tariff or add-on.
   9. The service includes access to emergency services (you should call 112) free of charge. However, access to emergency services requires there to be some power in your handset battery.
   10. The various customer support services provided by Vodafone change from time to time but details of the most up to date services, the means of obtaining these services and any associated charges are available at http://www.vodafone.ie/help/contact-us/.
3. How will you pay for the services and what happens if regular payments aren’t made?
   1. Vodafone offers a range of tariff plans with different rates and methods of charging. Charging rates and methods may vary depending on the type of call/data/text sent or received and further information on your tariff can be found here . Vodafone may from time to time vary the charges, the tariff plans (and tariff rules applicable thereto), rates or methods of payment and the terms of same. Vodafone reserves the right to cease offering and/or replace its tariff plans from time to time. Existing tariff plans may not always be available. You are advised to read the relevant Vodafone tariff rules and rates which are available from Vodafone. You may change from one tariff plan to certain other tariff plans subject to the tariff rules applicable thereto.
   2. Some independent retailers may apply a surcharge to call credit sold in their stores. Vodafone does not control the price at which credit is sold by independent third parties and any surcharge is at the discretion of such third party.
   3. You shall be liable for all charges incurred by you personally or otherwise through the use of the equipment calculated according to the relevant charging option (whether or not incurred by the Customer personally).
   4. Each 160 characters (or part thereof) of each non-MMS text message in the English language is charged as a separate text message. The number of characters allowed per text message may be reduced where the default language is changed from English. Please note that text messages sent over MMS are charged by reference to the volume of data sent. Whilst Vodafone will make every effort to ensure that all text messages are delivered, you shall be liable for all charges in respect of any text messages that are not delivered.
   5. Please note that transmissions over 3G or GPRS are charged on the basis of the volume of data/pages sent and/or received by your equipment over the network determination of the volume of data/pages shall be conclusive. For reasons beyond Vodafone's control, volumes may vary depending on the type of equipment used. Volume indications given on handset screens may not be accurate. If there is a minimum charge for each session conducted using your equipment and such session is terminated for any reason, the minimum charge may apply again if the connection is re-established.
   6. You may apply call credit to your account by means of any of the methods made available by Vodafone from time to time and may thereafter make Calls for a certain fixed period as advised by Vodafone from time to time (please refer to Vodafone's Customer Guide for details). The amount of the call credit will reduce as a result of Calls being made. No Calls may be made once all call credit has been used (with the exception of Calls to the emergency services). You may continue to receive Calls for a period of 8 months (or such other period as Vodafone may advise from time to time) following the date on which Call credit is last applied to your account. Top Up codes must be activated within two years of the issue date. After this period, it will not be possible to redeem any credit associated with the code.
   7. A minimum level of Call credit (as specified by Vodafone from time to time) must be applied to your Account at such intervals as Vodafone may specify from time to time failing which no Calls may be made (please refer to Vodafone's Customer Guide for details). All unused Call credit will be carried forward at the time Call credit is applied to your Account provided the minimum required level of Call credit has been applied to your Account at least once during the specified interval. Call credit may only be transferred to another Account owned by you in the event that Vodafone is satisfied that your equipment has been lost or stolen. Call credit may not be transferred to any third party account. If the equipment remains inactive or no call credit is applied for a period of 8 months or such other period as Vodafone may advise, all unused Call credit will be lost.
   8. Equipment is supplied for use on the Vodafone network. Certain network termination charges may apply in the event that you wish to use the Equipment on another mobile network and the amount of Call credit applied to your Account up to the date of termination is less than the amount specified by Vodafone from time to time.
   9. Please note that delays may occur in charging for certain text messaging services. This may result in an immediate reduction in your Call credit when Call credit is next applied to the Account.
   10. Any customer that has opted in to receiving marketing communications and tops up may at Vodafone’s absolute discretion be opted in to Cherry Points without further notice.
4. Your Obligations
   1. You are responsible for the acts and omissions of all persons using the equipment and password protected accounts. Without prejudice to any provision of this Contract, you agree:
      1. not to use or permit the use of the service or the equipment for any improper, indecent, obscene, unlawful, harmful, unauthorised, defamatory or fraudulent purpose or to cause any injury, offence or annoyance to any person or to send unsolicited commercial messages to any person;
      2. not to use or permit the use of the service or the equipment, so as to cause the operation of the network or the quality of service to be jeopardised, impaired or interrupted or to interfere with the integrity or security of any telecommunications or IT network or system;
      3. to only use type-approved equipment with the network, to comply with all laws, regulations and user guides governing its use and to remain solely responsible for the manner in which the equipment is used;
      4. to comply with all reasonable instructions or requests of Vodafone or an authorised authority, in particular as to the manner of using the service and in relation to the investigation of any offences;
      5. not to incite, encourage or induce members of the public to call a particular number simultaneously where this may adversely affect the service;
      6. to inform Vodafone immediately by telephone and (if Vodafone requires) confirm in writing, if the your equipment is lost, stolen or damaged.
   2. Vodafone shall not be responsible or liable for any content sent or received by you (including content which contains a virus or other harmful or unlawful material). Vodafone makes no representation and gives no warranty as to the quality, accuracy, correctness, completeness or suitability of any Call Content. Your reliance on or use of Call Content is at its sole risk. Call Content must not be exploited commercially to the detriment of Vodafone or any third party and must not be used to provide any other on-line or information service. Recipients of certain Call Content (in particular, multi-media messages) you may only be able to fully access it if the receiving equipment has the necessary functionality.
   3. You acknowledge and accept that Call Content may be protected by copyright, trademark or other intellectual property rights. You accept and agree that your Call Content may be manipulated, distorted, adapted, modified, stored or forwarded by others without restriction on wireless networks and the internet and Vodafone shall not be responsible or liable for such acts. You agree not to manipulate, distort, adapt, modify or forward any other Call Content without the prior consent of the holder of the rights in such content. You waive any right to be identified as the author of Call Content and the right not to have Call Content subject to derogatory treatment by others.
   4. You may, depending on the functionality of your equipment, be able to store Call Content in storage libraries hosted by Vodafone. Storage libraries may be password protected, in which case you must keep your password confidential. You shall be solely responsible for and shall notify Vodafone immediately of any unauthorised use of storage libraries. Storage libraries may have a limited capacity and Vodafone reserves the right to charge for storage capacity. Vodafone shall not be responsible for any loss or corruption of Call Content in storage libraries. Vodafone does not monitor storage libraries on an ongoing basis but it may be required to suspend access to or remove Call Content from storage libraries for legal reasons. There may be a charge for uploading or downloading Call Content to and from storage libraries hosted by Vodafone or other third parties, which shall be based on the volume of such Call Content and/or the airtime transmission (depending on the nature of the Call in question). Vodafone shall be entitled to delete the contents of storage libraries after the termination of this Contract or if the storage library has not been accessed for a period of 6 months.
   5. You may be advised of certain restrictions relating to the storage, manipulation and forwarding of certain Call Content that is downloaded and shall be liable for any failure to comply with such restrictions.
5. Suspension / Termination
   1. Vodafone may immediately, without notice, suspend or terminate the Service wholly or partially for any valid reason, including without limitation, where you:
      1. engage in any activity (or permits any activity) which Vodafone (as it in its sole discretion shall determine) considers (a) to be contrary to existing legislation or regulations applicable to provision of the Service or (b) is or is likely to have an adverse impact on the quality of the Service or the integrity of the Vodafone network. Such activities may include (but are not limited to) using the Service to make calls to or from any Mobile Gateway, ‘SIM box’ or similar or related devices; or
      2. fail to observe any term or obligation set out herein or any relevant law.
   2. Notwithstanding any other provision contained herein, Vodafone may by written notice terminate this Contract with effect from the date set out in the notice and thereupon cease to provide the Service, where:
      1. there is a serious failure by you to observe or perform any term or obligation set out herein or any relevant law;
      2. you fail to rectify a situation which has given rise to a suspension of the Service within 14 days of the suspension being imposed;
      3. you supply at any time false, inaccurate or misleading information to Vodafone;
      4. for any reason, Vodafone is unable to provide the Service to the Customer.
   3. Upon suspension or termination of the Contract, Vodafone shall disconnect the your equipment from the Network.
   4. Services are supplied for domestic use in the Republic of Ireland. From 4th Aug 2011 Vodafone will monitor the use of any newly activated SIM cards on its network to ensure that the SIM cards are being used in Ireland. In circumstances where there is no usage in Ireland following activation and/or there is only roaming usage in more than one calendar month, Vodafone reserves the right to deactivate the SIM card without further notice and the customer shall forfeit all credit on the account in such circumstances.
   5. Vodafone SIMs can only be provided to the end user by Vodafone or an authorised agent , where SIMs are procured through a third party (e.g. an online sales/auction site), Vodafone reserves the right to deactivate the SIM card without further notice and the customer shall forfeit all credit on the account in such circumstances.
6. Exclusion of Liability
   1. Insofar as it is permissible by law, Vodafone shall not be liable for any injury, loss or damage, whether foreseen or unforeseen, directly resulting from:
      1. any failure, interruption, delay, suspension or restriction (for whatever reason) in providing the Service to you which is due to any act of God, government control restrictions or prohibitions, any other act or omission of any public or regulatory authority (whether local, national, international or supranational), an act of default of any supplier, agent or other person, strikes, work stoppages or labour disputes or any other cause whatsoever which is beyond the reasonable control of Vodafone;
      2. any unlawful or unauthorised use of or access to the network, service or equipment by you or third parties;
      3. any claim arising out of any act or omission by you, your servants or agents or arising out of any reliance placed by such persons on Call Content ;
      4. any valid suspension of the service or termination of the Contract;
      5. any loss, theft or malfunction of the SIM card or equipment;
      6. any claim arising in relation to the provision (or non-provision), maintenance or use of telecommunications lines, channels, equipment, networks or services or arising out of Calls being dropped or GPRS Connections being lost for any reason;
      7. any claim arising out of or resulting from the quality or fitness for the purpose of, compliance with description of, or compliance with sample of any goods supplied to you unless you "deals as a consumer" within the meaning of the Sale of Goods and Supply of Services Act 1980.
   2. Vodafone will not be liable for any indirect or consequential loss or damage whatsoever, whether it is foreseen or unforeseen, including but not limited to loss of profits, data, revenue, business, anticipated savings or goodwill. Nothing herein shall have the effect of excluding or limiting the liability of Vodafone for death or personal injury resulting solely from its act or omission. Otherwise, any liability of Vodafone to you pursuant to this Contract shall not exceed the sum of €1,500 per claim.
   3. Vodafone will not be liable for the effects upon you, or upon any electronic or radio systems in equipment, vehicles or aircraft in your vicinity, of any emissions or transmissions to, from, through or by our network and/or the equipment.
   4. Vodafone accept no liability whatsoever for any product or service advertised or promoted, offered or sold by third party service providers for use on the Vodafone network or otherwise, including any mobile phone or device used in conjunction with the service.
   5. Vodafone shall exercise such reasonable skill and care in the provision of the service as may be expected of a reasonably competent mobile telecommunications operator. Except as expressly provided in the Contract, all conditions, terms, warranties and representations whether express or implied by law in relation to the provision of the service are excluded to the fullest extent permitted by the applicable law.
7. Directory Services and Caller Display
   1. Vodafone shall include you in Vodafone’s directory lists upon registration if you so request.
   2. Where you included in Vodafone’s directory list, Vodafone shall display your telephone number to called persons unless you request otherwise. Where you are not included in Vodafone’s directory list, you must specifically request the caller display service.
8. Numbers and SIM Card
   1. You shall not have any proprietary rights whatsoever in any mobile phone number allocated to you by Vodafone. Vodafone reserves the right at any time to alter or replace a mobile phone number allocated to you or any other name, code or number whatsoever associated with the Service.
   2. Vodafone shall issue you with and license you to use a Vodafone SIM Card on the condition that the Vodafone SIM Card shall remain the property of Vodafone and shall be returned to Vodafone upon request. Vodafone may charge you for the cost of checking, repairing or replacing a SIM Card.
9. Customer Information
   1. Your information, including traffic data (data relating to the conveyance of calls and the billing of such calls, including data relating to the routing, duration or time of calls, the location of equipment making or receiving calls, the network on which calls originate or terminate and the time of the beginning or end, or the duration of the connection to that telecommunications network) may be processed by Vodafone for its own business purposes. By entering into this Contract, you explicitly consents to the use of your information for these purposes which include account management, billing, debt collection, credit assessments, market research, customer profiling, product and service development, product and service marketing and customer care and other legitimate business purposes. Further information on how Vodafone obtains, holds and uses you information or data is available in our Privacy Policy which forms part of these General Terms and Conditions.
   2. Personal information will be retained for a reasonable period of time in a secure environment.
   3. Vodafone will find it necessary to disclose your information to Vodafone group companies, other licensed telecommunications operators and Vodafone’s agents for the purposes of providing the service and also to third parties (including credit bureau and other telecommunications operators) for the purpose of credit referencing, administration, account management, billing, customer profiling, market research, fraud prevention, debt collection, service and product development, insurance claims processing, porting and other legitimate business purposes. Personal data is not otherwise disclosed to third parties, save where required or permitted by law.
   4. Vodafone or Vodafone agents may from time to time contact you by post, telephone, e-mail or text message regarding details of specific promotions or information on various Vodafone products or services. You hereby explicitly consent to such contact while you are availing of the service and for a period of 12 months after you cease to avail of the service. If you does not wish to receive details of such promotions, you should contact Vodafone Customer Care. Non Vodafone customers who do not wish to receive details of such promotions, should send OPTOUT to 50308.
   5. Vodafone may in certain limited circumstances disclose certain information regarding the Accounts of Customers who are under the age of 16 years to the parents or guardians of such Customers who have registered with Vodafone for this purpose and who comply with the verification procedures specified by Vodafone. However, Vodafone may at its absolute discretion refuse to disclose any such information to any person in the event that Vodafone is not satisfied that the person requesting the information is the person who has registered with Vodafone for this purpose.
   6. Vodafone shall not provide you with any statements in relation to your Account or records of Calls made or received in the normal course of the Service.
10. General
    1. Any waiver, concession or extra time permitted by Vodafone is limited to the specific circumstances in which it is given and does not affect the rights of Vodafone under this Contract in any other way. This Contract is governed and construed in accordance with the laws of Ireland and the parties submit to the exclusive jurisdiction of the Courts of Ireland. Any reference to any legislative act or provision shall, unless the context otherwise requires, be considered as a reference to such act or provision as amended, re-enacted or replaced. Where Vodafone exercises any of its powers under this Clause 10, such exercise shall not prejudice or affect the exercise of any other right or remedy which may be available to Vodafone.
    2. Any notice which may be given by Vodafone shall without limiting the manner in which Vodafone may give such notice be deemed to have been duly given if the notice is sent to the Customer by ordinary post at your last notified address of the Customer on the second postal day after the date of posting or, if the notice is addressed to some or all Customers by advertisement, on the close of business on the day the advertisement appears in the national press. Notices may be incorporated in or associated with any other communication from Vodafone.
    3. If any provision of this Contract is held by any competent authority or by virtue of any change of legislation or for any other reason whatsoever to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Contract and the remainder of the provision(s) in question shall not be affected thereby.
    4. A copy of Vodafone’s Customer Enquiries Code of Practice for initiating (a) settlement of disputes with Vodafone or (b) requesting a refund or compensation for failure by Vodafone to meet contracted service quality levels is available here. Vodafone at its sole discretion shall decide on a case by case basis whether you are entitled to a refund or compensation. Vodafone’s decision in this regard is final and no correspondence will be entered into in relation to same save in the manner set out in the Code of Practice.
11. Roaming
    1. Under EU Roaming regulations you can use your monthly minutes, texts and data allocation while roaming in the EU in the same way you use the allowances domestically.  For any other destination the monthly allocations cannot be used while roaming
    2. Roaming is provided only on the basis of being an add-on to a core domestic service; conditions apply – see section 5.4 for additional information regarding applicability. We may bar roaming on any number with or without notice and before you receive notice (if we give any notice) to protect from fraud or misuse without incurring liability. A roaming bar may be applied with or without cause. If you promptly cure the breach, we may, but are not obligated to, reactivate service to you.
    3. In order to use this tariff you must be normally resident or have stable links entailing a frequent and substantial presence in the Republic of Ireland.  In order to ensure that roaming services are not subject to abusive or anomalous usage we may need request reasonable proof to determine your normal place of residence.  We may request this information before connecting you to our Services. See Vodafone.ie for a list of possible documentary evidence that we may require.
12. Porting
    1. Persons wishing to port to the Network from another mobile network will be subject to Vodafone’s Porting Requirements. Vodafone may vary the Vodafone Porting Requirements from time to time. If a deferred porting date has been requested, the Service and the Customer's obligations pursuant to this Contract shall not commence until the selected porting date.
    2. Customers wishing to port from the Network must contact the mobile operator to which they wish to port and will be responsible for complying with the porting requirements of that operator. Porting will be treated as a termination of this Contract. Customers are advised that that requests to port from the Network may be declined by Vodafone in the event that the Customer’s account is in arrears. Vodafone does not warrant, represent or guarantee that any Equipment will function or operate on any other operator’s telecommunications network.
13. Customer Authorisation Form
    1. Subscribers wishing to Port to the Vodafone network are subject to the following terms and conditions. You will also be subject to the terms and conditions of the Vodafone service that you subscribe to (e.g. Ready to Go service) in addition to these General Terms and Conditions. If you wish to Port to Vodafone you must fully complete the Customer Authorisation Form ("CAF") or the online porting process. Ports may be requested up to thirty days in advance of the required Porting date.
    2. You cannot withdraw your instruction to Port once the Porting process has commenced on Vodafone’s Porting systems. It may be possible to cancel a Port request prior to the commencement of the Porting process. Ports that can be cancelled may only be cancelled by requesting the cancellation in the same manner that the Port was originally requested (e.g. if you request the Port in a Vodafone store you must return to the same store to cancel it). The status of the Port at the time of cancellation will determine the inter-operator processes that follows. 
        Where you are dealing as a consumer this does not affect your cancellation rights and other rights you may have under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013.     3. Subject to Clause 13.6 below, your request to Port serves as formal notice on your current mobile operator ("the Donor Operator") of your termination of your contract for mobile telephony services with them (if any).
    4. You may only complete a CAF if you are the account holder (for post pay customers), the principal user of the account (for pay as you go) or the account authorised representative (for corporate or business accounts) as recorded in your Donor Operator’s records. By completing a CAF you warrant, represent and confirm to Vodafone that you are the account holder, principal user or authorised representative as appropriate.
    5. You acknowledge that:
       1. only your MSISDN will be Ported;
       2. services offered by your Donor Operator will not necessarily be transferred or available on the Vodafone network, this will include the loss of Voicemail messages, SMS messages, data or facsimile services;
       3. you will lose all call credit in your account immediately on the Port being completed;
       4. you may have outstanding contractual obligations including outstanding invoices and/or termination charges owed to your Donor Operator, and you remain liable and responsible for these matters;
       5. you may need to get SIM security or network locking functions removed by your Donor Operator or get a new handset;
       6. your existing handset may not be type-approved on the Vodafone network and performance or functionality may vary as a result of this. Certain settings (e.g. WAP) may require updating.
    6. Port requests may be rejected if:
       1. the information you provide is incorrect, inaccurate, false, misleading or does not match the data held by your Donor Operator;
       2. the MSISDN in your possession has been reported lost or stolen;
       3. your MSISDN has been returned to the pool of available MSISDN’s following cessation of use or termination as follows:
       4. for pay as you go, no customer activity on account for a period of 6 months; or
       5. for postpaid, account terminated for over twelve (12) months.
       6. there are arrears outstanding to your existing mobile operator.
    7. Vodafone does not warrant, represent or undertake that your MSISDN will be Ported within any specified timeframe or at all. Please note that it may not be possible to port your MSISDN at your preferred time.
    8. During the Porting process there may be a period of outage of your mobile service and/or any related or ancillary services, Vodafone will not be liable or responsible for any damage, loss, costs or expenses or other liability in contract, tort or otherwise direct or indirect incurred as a result thereof.
    9. In this Clause 13 the following words have the following meanings:
       • Donor Operator (DO) 
          Means your current third party mobile telephony service provider (e.g. O2, Meteor, 3)
       • MSISDN 
          Means the ten digit Mobile Station Integrated Services Digital Network Number (i.e. the mobile telephone number) programmed into a subscriber’s SIM Card (e.g. 087 xxx xxxx).
       • Port 
          Means the process for mobile number portability whereby a subscriber to a mobile telephony network may move their MSISDN from their Donor Operator to a new mobile operator without altering the MSISDN. Words such as Porting, Ported, etc shall be construed accordingly.
14. Clause

    For all customers signing up to Vodafone on or after 1 March 2014 the following clauses will apply;

    1. From time to time Vodafone may modify the standard settings and/or features of any Service, tariff or package that we provide to you in order to offer additional value to the Service or package. Such changes might include increasing your data, voice or text allowances or improving your connectivity speeds. The parties agree that such changes to the Service or package do not constitute modification in the conditions of the contract for that Service or package, and the Customer confirms that it does not require individual contract change notifications regarding any such modification.
    2. Vodafone may change its Service delivery methods or platforms from time to time which may require the Customer to change Equipment and/or Equipment settings to continue to avail of the Services. The parties agree that such changes to the Service do not constitute modification in the conditions of the contract for that Service or package, and the Customer confirms that it does not require individual notification regarding any such modification

General terms and conditions of Vodafone Pay as you go Mobile Telecommunications Service (pre 13 June 2011)

Definitions

The following words and expressions have the following meanings:

·         “3G Session” means an internet session established using 3G technology;

·         "Account" means the Customer's Vodafone pay as you go mobile telephony account;

·         "Call" means a transmission made over a telecommunications network for the purpose of communicating a voice or data message (which includes, without limitation, short text messages, multi-media messages and calls to WAP services);

·         "Call Content" means the content of any voice or data Call received or made by a Customer over the Network;

·         "Charges" means the charges for the Service as published in Vodafone’s periodically updated tariff guides including, but not limited to, service options, tariff charges, Call charges (which may vary depending on the type of Call made), GPRS Connection charges and administrative charges) and certain Third Party Services which the Customer may choose to receive;

·         "Customer" means the customer who is connected to the Network by Vodafone;

·         "Equipment" means the Customer’s type approved mobile terminal and the Vodafone SIM card which is connected by Vodafone to the Network pursuant to this Contract;

·         “GPRS Session” means a WAP or internet session established using GPRS technology;

·         “Minimum Period” means such period specified on the Customer Application Form or in the absence of any period therefore 12 months commencing on the date of the Customer’s connection to the Network;

·         "Network" means the mobile telecommunications network and systems used to provide the Service;

·         "Service" means the pay as you go mobile telephony service provided by Vodafone, which enables the Customer to make or receive Calls over the Network and any additional services provided by Vodafone over the Network from time to time;

·         "the Territory" means Ireland (excluding Northern Ireland);

·         "Third Party Service" means any service promoted or provided by third parties to the Customer over the Network;

·         "Vodafone" means Vodafone Ireland Limited whose registered office is at Mountain View, Leopardstown, Dublin 18;

·         "Vodafone Agent" means any person authorised to promote and sell the Service or carry out business activities on Vodafone’s behalf.

1. General

1.1 These Terms and Conditions and the terms and conditions of any applicable Service options or promotions constitute a legally binding contract (the "Contract") between Vodafone and the Customer. This Contract shall commence when Vodafone connects the Customer to the Network. Please note that various related Vodafone products and services and Third Party Services may be subject to additional terms and conditions which you are advised to read.

1.2 Vodafone reserves the right to alter any terms of this Agreement for legal, technical, operational or commercial reasons, or to terminate any package or change its tariffs, on giving thirty (30) days’ notice to the Customer. In the event of any such alteration, the Customer shall have the option to terminate the Service without penalty during the notice period, subject to payment by the Customer of all Charges due to date.  Please note that Vodafone Agents are not authorised to amend this Contract or to agree any provision which is inconsistent herewith. Your continued use of the Service signifies your acceptance of any amendment.

1.3 This Contract is personal to the Customer. The Customer shall not assign or otherwise transfer the Contract in whole or in part.

1.4 Any waiver, concession or extra time permitted by Vodafone is limited to the specific circumstances in which it is given and does not affect the rights of Vodafone under this Contract in any other way. This Contract is governed and construed in accordance with the laws of Ireland and the parties submit to the exclusive jurisdiction of the Courts of Ireland. Any reference to any legislative act or provision shall, unless the context otherwise requires, be considered as a reference to such act or provision as amended, re-enacted or replaced.

1.5 Any notice which may be given by Vodafone shall without limiting the manner in which Vodafone may give such notice be deemed to have been duly given if the notice is sent to the Customer by ordinary post at the last notified address of the Customer on the second postal day after the date of posting or, if the notice is addressed to some or all Customers by advertisement, on the close of business on the day the advertisement appears in the national press. Notices may be incorporated in or associated with any other communication from Vodafone.

1.6 If any provision of this Contract is held by any competent authority or by virtue of any change of legislation or for any other reason whatsoever to be invalid or unenforceable in whole or in part, the validity of the other provisions of the Contract and the remainder of the provision(s) in question shall not be affected thereby.

1.7A copy of Vodafone’s Customer Enquiries Code of Practice for initiating (a) settlement of disputes with Vodafone or (b) requesting a refund or compensation for failure by Vodafone to meet contracted service quality levels is available here. Vodafone at its sole discretion shall decide on a case by case basis whether a Customer is entitled to a refund or compensation. Vodafone’s decision in this regard is final and no correspondence will be entered into in relation to same save in the manner set out in the Code of Practice.

2. Service

2.1 The quality and the availability of the Service and related Vodafone products and services is subject to certain limitations, including the proximity of base stations and circumstances beyond Vodafone’s reasonable control including, but not limited to, geographic and atmospheric conditions and the functional capability of Customer Equipment. Vodafone does not represent or warrant that the operation of the Service or related Vodafone products and services will be uninterrupted, timely, secure or error-free or that it will meet any Customers specific requirements. In particular Vodafone does not represent or warrant that Calls will not be dropped, 3G or GPRS Sessions will not be lost, transmission of data calls shall occur at any particular speed or that all traffic can or will be transmitted by the Network. Vodafone does not accept responsibility for the security of 3G or GPRS Sessions. The Customer conducts any 3G or GPRS Session at its own risk and is solely responsible for adopting such appropriate security measures against unauthorised access to and interference with Equipment (or associated software/hardware and data) as may be necessary.

2.2 Vodafone may modify or suspend the Service wholly or partially, with or without notice, if such action is deemed necessary by Vodafone (e.g. for maintenance, security or other valid reasons) or if Vodafone is requested by an authorised authority or required to do so by legislation or for technical, maintenance, security or other valid reasons. All reasonable efforts shall be made to minimise such Service disruptions. The Customer shall remain liable for all Charges during any such Service disruptions unless Vodafone decides otherwise.

2.3 Vodafone reserves the right, without prejudice to any other provisions of this Contract, to issue such reasonable instructions concerning the use of the Service as may be necessary in the interests of safety, quality of service, other customers or telecommunications services as a whole, or for any other valid reason Vodafone deems sufficient.

2.4 The Customer may not make certain types of Calls using the Equipment. Please refer to Vodafone’s Customer Guide for details.

2.5 All incoming voice calls which are not answered or which are received when the Equipment is busy, switched off or out of coverage will be automatically diverted to the Vodafone voicemail service and this functionality may not be altered.

2.6 Vodafone makes no representation and gives no warranty as to the content, quality, availability, suitability or timeliness of any Third Party Service. Vodafone reserves the right to suspend or withdraw access to all or any such Third Party Services on a temporary or permanent basis at any time. The Customer’s use of such Third Party Services is at the Customer’s sole risk and Vodafone shall not be responsible or liable for any loss or damage suffered by the Customer arising from the use of such services. Vodafone may be required to charge the Customer for such services.

2.7 Vodafone continuously monitors network performance to ensure that the service received by customers is not impacted through a minority of users placing high demand on network resources (e.g. large bandwidths over long periods). Any such high-demand users can expect to experience reduced speeds at peak times .Peak times are subject to ongoing change based on actual network demands. This service does not support ‘calls over the internet' or data sharing for any new customers or customers upgrading their tariff or Equipment from [10 March 2010] onwards. If you want to use data services like making calls over the internet or sharing data files over the internet you should choose a tailored data tariff or add-on.

3. Payment

3.1 The following payments shall apply:

1.             Vodafone shall normally offer a range of tariff plans with different rates and methods of charging. Charging rates and methods may vary depending on the type of Call sent or received. Vodafone may from time to time vary the Charges, the tariff plans (and tariff rules applicable thereto), rates or methods of payment and the terms of same. Vodafone reserves the right to cease offering and/or replace its tariff plans from time to time. Existing tariff plans may not always be available. You are advised to read the relevant Vodafone tariff rules and rates which are available from Vodafone.The Customer may change from one tariff plan to certain other tariff plans subject to the tariff rules applicable thereto.

2.             The Customer shall be liable for all Charges incurred by the Customer personally or otherwise through the use of the Equipment calculated according to the relevant charging option (whether or not incurred by the Customer personally).

3.             Each 160 characters (or part thereof) of each non-MMS text message in the English language is charged as a separate text message. The number of characters allowed per text message may be reduced where the default language is changed from English. Please note that text messages sent over MMS are charged by reference to the volume of data sent. Whilst Vodafone will make every effort to ensure that all text messages are delivered, the Customer shall be liable for all Charges in respect of any text messages that are not delivered.

4.             Please note that Calls over 3G or GPRS are charged on the basis of the volume of data/pages sent and/or received by the Customer’s Equipment over the Network determination of the volume of data/pages shall be conclusive. For reasons beyond Vodafone's control, volumes may vary depending on the type of Equipment used by the Customer. Volume indications given on handset screens may not be accurate. There will be a minimum charge for each 3G or GPRS Session conducted using the Customer's Equipment during which the Customer accesses non-Vodafone Call Content (except in the case of multi-media messaging Calls). If such a 3G or GPRS Session is terminated for any reason, the minimum charge shall apply again if it is re-established.

5.             The Customer may apply Call credit to their Account by means of any of the methods made available by Vodafone from time to time and may thereafter make Calls for a certain fixed period as advised by Vodafone from time to time (please refer to Vodafone's Customer Guide for details). The amount of the Call credit will reduce as a result of Calls being made. No Calls may be made once all Call credit has been used (with the exception of Calls to the emergency services and the Vodafone Talkback service). The Customer may continue to receive Calls for a period of 8 months (or such other period as Vodafone may advise from time to time) following the date on which Call credit is last applied to their Account. Top Up codes must be activated within two years of the issue date. After this period, it will not be possible to redeem any credit associated with the code.

6.             A minimum level of Call credit (as specified by Vodafone from time to time) must be applied to the Customer's Account at such intervals as Vodafone may specify from time to time failing which no Calls may be made by the Customer (please refer to Vodafone's Customer Guide for details). All unused Call credit will be carried forward at the time Call credit is applied to the Customer's Account provided the minimum required level of Call credit has been applied to the Customer's Account at least once during the specified interval. Call credit may only be transferred to another Account owned by the Customer in the event that Vodafone is satisfied that the Customer's Equipment has been lost or stolen. Call credit may not be transferred to any third party account. If the Equipment remains inactive or no call credit is applied for a period of 8 months or such other period as Vodafone may advise, all unused Call credit will be lost.

7.             Certain network termination charges may apply in the event that the Customer wishes to use the Equipment on another mobile network and the amount of Call credit applied to the Customer's Account up to the date of termination is less than the amount specified by Vodafone from time to time.

8.             Please note that delays may occur in charging for certain text messaging services. This may result in an immediate reduction in the Customer's Call credit when Call credit is next applied to the Account.

9.             Any customer that has opted in to receiving marketing communications and tops up after 15 March 2011 may also at Vodafone absolute discretion be opted in to Cherry Points without further notice to the customer.

4. Customer Obligations

4.1 The Customer is responsible for the acts and omissions of all persons using the Customer’s Equipment and password protected accounts. Without prejudice to any provision of this Contract, the Customer agrees:

1.             not to use or permit the use of the Service or the Equipment for any improper, indecent, obscene, unlawful, harmful, unauthorised, defamatory or fraudulent purpose or to cause any injury, offence or annoyance to any person or to send unsolicited commercial messages to any person;

2.             not to use or permit the use of the Service or the Equipment, so as to cause the operation of the Network or the quality of Service to be jeopardised, impaired or interrupted or to interfere with the integrity or security of any telecommunications or IT network or system;

3.             to only use type-approved Equipment with the Network, to comply with all laws, regulations and user guides governing its use and to remain solely responsible for the manner in which the Equipment is used;

4.             to comply with all reasonable instructions or requests of Vodafone or an authorised authority, in particular as to the manner of using the Service and in relation to the investigation of any offences;

5.             not to incite, encourage or induce members of the public to call a particular number simultaneously where this may adversely affect the Service;

6.             to inform Vodafone immediately by telephone and (if Vodafone requires) confirm in writing, if the Customer’s Equipment is lost, stolen or damaged.

4.2 Vodafone shall not be responsible or liable for any Call Content sent or received by the Customer (including content which contains a virus or other harmful or unlawful material). Vodafone makes no representation and gives no warranty as to the quality, accuracy, correctness, completeness or suitability of any Call Content. The Customer’s reliance on or use of Call Content is at its sole risk. Call Content must not be exploited commercially to the detriment of Vodafone or any third party and must not be used to provide any other on-line or information service. Recipients of certain Call Content (in particular, multi-media messages) from the Customer may only be able to fully access it if the receiving equipment has the necessary functionality.

4.3 The Customer acknowledges and accepts that Call Content may be protected by copyright, trademark or other intellectual property rights. Customers accept and agree that their Call Content may be manipulated, distorted, adapted, modified, stored or forwarded by others without restriction on wireless networks and the internet and Vodafone shall not be responsible or liable for such acts. The Customer agrees not to manipulate, distort, adapt, modify or forward any other Call Content without the prior consent of the holder of the rights in such content. The Customer waives any right to be identified as the author of Call Content and the right not to have Call Content subject to derogatory treatment by others.

4.4 Customers may, depending on the functionality of their Customer Equipment, be able to store Call Content in storage libraries hosted by Vodafone. Storage libraries may be password protected, in which case Customers must keep their password confidential. The Customer shall be solely responsible for and shall notify Vodafone immediately of any unauthorised use of storage libraries. Storage libraries may have a limited capacity and Vodafone reserves the right to charge for storage capacity. Vodafone shall not be responsible for any loss or corruption of Call Content in storage libraries. Vodafone does not monitor storage libraries on an ongoing basis but it may be required to suspend access to or remove Call Content from storage libraries for legal reasons. There may be a charge for uploading or downloading Call Content to and from storage libraries hosted by Vodafone or other third parties, which shall be based on the volume of such Call Content and/or the airtime transmission (depending on the nature of the Call in question). Vodafone shall be entitled to delete the contents of storage libraries after the termination of this Contract or if the storage library has not been accessed for a period of 6 months.

4.5 The Customer may be advised of certain restrictions relating to the storage, manipulation and forwarding of certain Call Content that is downloaded and shall be liable for any failure to comply with such restrictions.

5. Suspension / Termination

5.1 Vodafone may immediately, without notice, suspend or terminate the Service to the Customer wholly or partially for any valid reason, including without limitation, where:

1.             the Customer engages in any activity (or permits any activity) which Vodafone (as it in its sole discretion shall determine) considers (a) to be contrary to existing legislation or regulations applicable to provision of the Service or (b) is or is likely to have an adverse impact on the quality of the Service or the integrity of the Vodafone network. Such activities may include (but are not limited to) using the Service to make calls to or from any Mobile Gateway, ‘SIM box’ or similar or related devices; or

2.             where the Customer fails to observe any term or obligation set out herein (and in particular the Customer Obligations referred to in Clause 4) or any relevant law.

5.2 Notwithstanding any other provision contained herein, Vodafone may by written notice terminate this Contract with effect from the date set out in the notice and thereupon cease to provide the Service to the Customer, where:

1.             there is a serious failure by the Customer to observe or perform any term or obligation set out herein (and in particular the Customer Obligations referred to in Clause 4) or any relevant law;

2.             the Customer fails to rectify a situation which has given rise to a suspension of the Service under Clause 5.1 within 14 days of the suspension being imposed;

3.             the Customer supplies at any time false, inaccurate or misleading information to Vodafone;

4.             if, for any reason, Vodafone is unable to provide the Service to the Customer.

5.3 Upon suspension or termination of the Contract, Vodafone shall disconnect the Customer’s Equipment from the Network.

5.4 Where Vodafone exercises any of its powers under this Clause 5, such exercise shall not prejudice or affect the exercise of any other right or remedy which may be available to Vodafone.

6. Exclusion of Liability

6.1 Insofar as it is permissible by law, Vodafone shall not be liable for any injury, loss or damage, whether foreseen or unforeseen, directly resulting from:

1.             any failure, interruption, delay, suspension or restriction (for whatever reason) in providing the Service to the Customer which is due to any act of God, government control restrictions or prohibitions, any other act or omission of any public or regulatory authority (whether local, national, international or supranational), an act of default of any supplier, agent or other person, strikes, work stoppages or labour disputes or any other cause whatsoever which is beyond the reasonable control of Vodafone;

2.             any unlawful or unauthorised use of or access to the Network, Service or Equipment by the Customer or third parties;

3.             any claim arising out of any act or omission by the Customer, its servants or agents or arising out of any reliance placed by such persons on Call Content ;

4.             any valid suspension of the Service or termination of the Contract;

5.             any loss, theft or malfunction of the Customer’s SIM card or Equipment;

6.             any claim arising in relation to the provision (or non-provision), maintenance or use of telecommunications lines, channels, equipment, networks or services or arising out of Calls being dropped or GPRS Connections being lost for any reason;

7.             any claim arising out of or resulting from the quality or fitness for the purpose of, compliance with description of, or compliance with sample of any goods supplied to a Customer unless the Customer "deals as a consumer" within the meaning of the Sale of Goods and Supply of Services Act 1980.

6.2 Vodafone will not be liable for any indirect or consequential loss or damage whatsoever, whether it is foreseen or unforeseen, including but not limited to loss of profits, data, revenue, business, anticipated savings or goodwill. Nothing herein shall have the effect of excluding or limiting the liability of Vodafone for death or personal injury resulting solely from its act or omission. Otherwise, any liability of Vodafone to the Customer pursuant to this Contract shall not exceed the sum of €1,500 per claim.

6.3 Vodafone will not be liable for the effects upon the Customer, or upon any electronic or radio systems in equipment, vehicles or aircraft in the Customers vicinity, of any emissions or transmissions to, from, through or by our Network and/or the Equipment.

6.4 Vodafone accept no liability whatsoever for any product or service advertised or promoted, offered or sold by third party service providers for use on the Vodafone Network or otherwise, including any mobile phone or device used in conjunction with the Service.

6.5 Vodafone shall exercise such reasonable skill and care in the provision of the Service as may be expected of a reasonably competent mobile telecommunications operator. Except as expressly provided in the Contract, all conditions, terms, warranties and representations whether express or implied by law in relation to the provision of the Service are excluded to the fullest extent permitted by the applicable law.

7. Directory Services and Caller Display

7.1 Vodafone shall include the Customer in Vodafone’s directory lists upon registration if the Customer so requests.

7.2 Where the Customer is included in Vodafone’s directory list, Vodafone shall display the Customer’s telephone number to called persons unless the Customer requests otherwise. Where the Customer is not included in Vodafone’s directory list, the Customer must specifically request the caller display service.

8. Numbers and SIM Card

8.1 The Customer shall not have any proprietary rights whatsoever in any mobile phone number allocated to the Customer by Vodafone from time to time. Vodafone reserves the right at any time to alter or replace a mobile phone number allocated to the Customer or any other name, code or number whatsoever associated with the Service.

8.2 Vodafone shall issue the Customer with and license the Customer to use a Vodafone SIM Card on the condition that the Vodafone SIM Card shall remain the property of Vodafone and shall be returned to Vodafone upon request. Vodafone may charge the Customer for the cost of checking, repairing or replacing a SIM Card.

9. Customer Information

9.1 1Customer information, including traffic data (data relating to the conveyance of calls and the billing of such calls, including data relating to the routing, duration or time of calls, the location of equipment making or receiving calls, the network on which calls originate or terminate and the time of the beginning or end, or the duration of the connection to that telecommunications network) may be processed by Vodafone for its own business purposes. By entering into this Contract, the Customer explicitly consents to the use of Customer information for these purposes which include account management, billing, debt collection, credit assessments, market research, customer profiling, product and service development, product and service marketing and customer care and other legitimate business purposes. Further information on how Vodafone obtains, holds and uses such Customer information or data is available in our Privacy Policy which forms part of these General Terms and Conditions.

9.2 Personal information will be retained for a reasonable period of time in a secure environment. Please note that Customer calls to Vodafone Customer Care may be recorded for training and quality control purposes.

9.3 Vodafone will find it necessary to disclose certain Customer information to Vodafone group companies, other licensed telecommunications operators and Vodafone’s Agents for the purposes of providing the Service and also to third parties (including credit bureau and other telecommunications operators) for the purpose of credit referencing, administration, account management, billing, customer profiling, market research, fraud prevention, debt collection, Service and product development, insurance claims processing, porting and other legitimate business purposes. Personal data is not otherwise disclosed to third parties, save where required or permitted by law

9.4 Vodafone or Vodafone Agents may from time to time contact the Customer by post, telephone, e-mail or text message regarding details of specific promotions or information on various Vodafone products or services. The Customer hereby explicitly consents to such contact while the Customer is availing of the Service and for a period of 12 months after the Customer ceases to avail of the Service. If the Customer does not wish to receive details of such promotions, the Customer should contact Vodafone Customer Care.

9.5 Vodafone may in certain limited circumstances disclose certain information regarding the Accounts of Customers who are under the age of 16 years to the parents or guardians of such Customers who have registered with Vodafone for this purpose and who comply with the verification procedures specified by Vodafone. However, Vodafone may at its absolute discretion refuse to disclose any such information to any person in the event that Vodafone is not satisfied that the person requesting the information is the person who has registered with Vodafone for this purpose.

9.6 Vodafone shall not provide the Customer with any statements in relation to their Account or records of Calls made or received in the normal course of the Service.

10. Roaming

10.1 Customers may only use the Service whilst located outside the Territory if roaming facilities have been granted to the Customer by Vodafone. Customers should contact Vodafone Ready to Go Customer Care on 1747 (from a mobile)  or 1850 20 40 20  (from a landline) in this regard. Access to local networks shall depend upon the arrangements between local operators and Vodafone and the ability of local operators to support USSD technology. Customers may receive, but will not be able to transmit, text messages whilst located outside the Territory. Special charges shall apply to such Customers who are using the Service outside the Territory. Please refer to Vodafone’s current tariff guides for details.

10.2 Vodafone may disclose Customer information to other licensed operators in order to assist in the prevention of the fraudulent use of our telecommunication system or the telecommunication system of another licensed operator.

11. Porting

11.1 Persons wishing to port to the Network from another mobile network will be subject to Vodafone’s Porting Requirements. Vodafone may vary the Vodafone Porting Requirements from time to time. If a deferred porting date has been requested, the Service and the Customer's obligations pursuant to this Contract shall not commence until the selected porting date.

11.2 Customers wishing to port from the Network must contact the mobile operator to which they wish to port and will be responsible for complying with the porting requirements of that operator. Porting will be treated as a termination of this Contract. Customers are advised that that requests to port from the Network may be declined by Vodafone in the event that the Customer’s account is in arrears. Vodafone does not warrant, represent or guarantee that any Equipment will function or operate on any other operator’s telecommunications network.

12. Customer Authorisation Form

12.1 Subscribers wishing to Port to the Vodafone network are subject to the following terms and conditions. You will also be subject to the terms and conditions of the Vodafone service that you subscribe to (e.g. Ready to Go service) in addition to these General Terms and Conditions. If you wish to Port to Vodafone you must fully complete the Customer Authorisation Form ("CAF") or the online porting process. Ports may be requested up to thirty days in advance of the required Porting date. 

12.2 You cannot withdraw your instruction to Port once the Porting process has commenced on Vodafone’s Porting systems. It may be possible to cancel a Port request prior to the commencement of the Porting process. Ports that can be cancelled may only be cancelled by requesting the cancellation in the same manner that the Port was originally requested (e.g. if you request the Port in a Vodafone store you must return to the same store to cancel it). The status of the Port at the time of cancellation will determine the inter-operator processes that follows. 
 Where you are dealing as a consumer this does not affect your cancellation rights and other rights you may have under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. 12.3 Subject to Clause 12.6 below, your request to Port serves as formal notice on your current mobile operator ("the Donor Operator") of your termination of your contract for mobile telephony services with them (if any). 

12.4 You may only complete a CAF if you are the account holder (for post pay customers), the principal user of the account (for pay as you go) or the account authorised representative (for corporate or business accounts) as recorded in your Donor Operator’s records. By completing a CAF you warrant, represent and confirm to Vodafone that you are the account holder, principal user or authorised representative as appropriate. 

12.5 You acknowledge that: 

1.             only your MSISDN will be Ported;

2.             services offered by your Donor Operator will not necessarily be transferred or available on the Vodafone network, this will include the loss of Voicemail messages, SMS messages, data or facsimile services;

3.             you will lose all call credit in your account immediately on the Port being completed;

4.             you may have outstanding contractual obligations including outstanding invoices and/or termination charges owed to your Donor Operator, and you remain liable and responsible for these matters;

5.             you may need to get SIM security or network locking functions removed by your Donor Operator or get a new handset;

6.             your existing handset may not be type-approved on the Vodafone network and performance or functionality may vary as a result of this. Certain settings (e.g. WAP) may require updating.

12.6 Port requests may be rejected if:

1.             the information you provide is incorrect, inaccurate, false, misleading or does not match the data held by your Donor Operator;

2.             the MSISDN in your possession has been reported lost or stolen;

3.             your MSISDN has been returned to the pool of available MSISDN’s following cessation of use or termination as follows: 
 (i) for pay as you go,  no customer activity on account for a period of 6 months; or 
 (ii) for postpaid, account terminated for over twelve (12) months.

4.             there are arrears outstanding to your existing mobile operator.

If you supply fraudulent, false or misleading information you acknowledge that you will be personally liable and responsible for such information, you may, in appropriate cases, be referred to the lawful authorities for prosecution. 

12.7 Vodafone does not warrant, represent or undertake that your MSISDN will be Ported within any specified timeframe or at all. Please note that it may not be possible to port your MSISDN at your preferred time. 

12.8 During the Porting process there may be a period of outage of your mobile service and/or any related or ancillary services, Vodafone will not be liable or responsible for any damage, loss, costs or expenses or other liability in contract, tort or otherwise direct or indirect incurred as a result thereof. 

12.9 In this Clause 12 the following words have the following meanings: 

Donor Operator (DO) 
Means your current third party mobile telephony service provider (e.g. O2, Meteor, 3) 

MSISDN
Means the ten digit Mobile Station Integrated Services Digital Network Number (i.e. the mobile telephone number) programmed into a subscriber’s SIM Card (e.g. 087 xxx xxxx). 

Port
Means the process for mobile number portability whereby a subscriber to a mobile telephony network may move their MSISDN from their Donor Operator to a new mobile operator without altering the MSISDN. Words such as Porting, Ported, etc shall be construed accordingly.

100 Free International Minutes Bundle

Where applicable. under EU Roaming regulations you can use your monthly minutes allocation while roaming in the EU in the same way you use the allowance domestically.  For any other destination the monthly allocation cannot be used while roaming.

·         The following terms and conditions of the Vodafone Free International Minutes Bundle (the “Bundle”) are in addition to and form part of the terms and conditions of the Free Calls and Texts and Mobile Internet Offer Terms and the Free Texts to Any Network and Mobile Internet Offer terms which are available on www.vodafone.ie

·         The Bundle is only available to Vodafone Pay As You Go mobile phone customers on the Free Calls and Texts and Mobile Internet or the Free Texts to Any Network and Mobile Internet offers from September 2nd 2013 until June 2014

·         A Customer who has opted into the Free Calls and Texts and Mobile Internet Offer or the Free Texts to Any Network and Mobile Internet Offer tariffs & topped up by €30 or more in a single transaction, will receive 100 free international minutes valid for a 30 day period in addition to the benefits outlined in the terms and conditions of the Free Calls and Texts and Mobile Internet Offer or the Free Texts to Any Network and Mobile Internet Offer, as applicable.

·         The 100 free international minutes will be applied within 24 hours of the qualifying top up of €30 taking place. Customers will receive notification when the Bundle has been applied.

·         A Customer shall not be entitled to carryover unused international minutes from one top up period to the next. Customers who top up by a further €30 or more in a single transaction during the applicable 4 week period will have their international minutes balance reset to 100 minutes and the expiry date reset to 30 days from the date of the most recent €30 top up.

The following terms and conditions of the Vodafone Free International Minutes, free Internet & Free Vodafone Calls & Texts  offer (the "FREE international minutes &internet Promotion") are in addition to and form part of the terms and conditions of the Vodafone Ireland Limited's ("Vodafone's") mobile telecommunications service & terms and conditions of the Free Calls and Texts offer and the Vodafone Mobile Internet Terms and Conditions which are available on this website. These terms and conditions will change on 15th January 2013 see the customer notification page for details. In the event of any conflict the terms and conditions below shall prevail.

1. The Offer is only available to pay as you go mobile phone customers of Vodafone on the Vodafone Advantage Plus Tariff ("Customers") who sign up to the Offer before December 31, 2013.

2. Customers who opt into the Offer will be automatically signing up to our Vodafone Advantage Plus Tariff.

3. 13.  Customer who top up by another €30 before 30 day period has ended will receive a new allocation of 100 international minutes, 250MB of internet and any unused allocation from previous 30 day period will be added to the new allocation. The expiry date will be reset to 30 days.

14.  If a customer has opted in to the Offer & tops up by €20, they will still receive free Vodafone calls & texts but will not receive their allocation of 100 free international minutes and 250MB of internet until their next top up of €30

1. When you sign up to the Offer you will be automatically signing up to our Vodafone Advantage Plus tariff and Advantage Plus rates will apply after opt in. For further details of this Tariff see terms and conditions.
2. The Offer of unlimited calls and texts to any network and 1GB of data for €20 credit from your top up is available until otherwise notified by Vodafone.
3. This Offer is subject to a Fair Usage Policy. Vodafone has developed a threshold for the Service which is currently set at 5,000 text messages to any Irish network and 5,000 minutes to national mobiles and landlines. If, Vodafone is of the opinion, that your usage of the Service materially exceeds these thresholds over the applicable 28 day Offer period, Vodafone may contact you to advise you that your usage exceeds its Fair Usage Policy. If such excessive usage continues to exceed the above thresholds after receipt of a request to desist from or alter the nature of such usage, Vodafone reserves the right, to charge you for the excessive element of your usage at Vodafone Advantage Plus rates or to suspend, modify or restrict your use of the Service or to withdraw your access to the Offer.

8. Chat Extra elements of inclusive calls, texts and mobile data cannot be used when roaming.
9. When you top up by €20 or more in one transaction, €20 charge will be debited from your credit and the Offer will activate. This €20 charge will apply each time you top up by €20 or more in one transaction.
10. If you need to top up again during your 28 day Offer period, it is recommended that you top up by less than the minimum amount if you want to retain the Offer benefits for your existing 28 day Offer period. i.e. €5, €10 or €15 top up. A top up by €20 or more within an existing 28 day Offer period will activate the Offer and a new 28 day Offer period will commence.
11. The benefits of the Offer will only be applied once you top up by €20 or more in one transaction.

Vodafone does not warrant or represent that it shall send such a reminder and it shall not be responsible for any liability incurred by Customers as a result of its failure to do so.

Terms and Conditions of the Vodafone Cherry Points Scheme

1.     These terms and conditions apply to the loyalty point scheme whereby Vodafone customers are awarded points (“Cherry Points”) for money spent on call credit with Vodafone (the “Vodafone Cherry Points Scheme”).

2.     The Vodafone Cherry Points Scheme is only for personal and consumer use. Points cannot be transferred, sold or in any way traded.

3.     The Vodafone Cherry Points Scheme is currently only available to Vodafone pay as you go customers. In the event of Vodafone pay as you go customer moving to bill pay their Cherry Points account will be frozen and they will not continue to accumulate Cherry Points. They will be given a set of options of products and services that they can redeem their Cherry Points balance against within a given timeframe.

4.     You must be opted in to the Vodafone Cherry Points Scheme in order to accumulate Cherry Points. Registration is either through Vodafone.ie or by text shortcode, details of which can be found on Vodafone.ie

5.     Accumulated Cherry Points can be used to purchase certain products as indicated by Vodafone.

6.     To redeem Cherry Points, customers must register their details on Vodafone.ie. An IMEI number may not be registered more than once.

7.     You must spend at least €1 in a single transaction for the transaction to qualify for Cherry Points. One Cherry Point will be awarded for every €1 that is spent. Cherry Points will not be awarded for registration credit, bonus credit, or any other form of credit which is not directly paid for by the customer. This can be altered at the discretion of Vodafone Ireland. Vodafone Ireland shall be entitled to set a limit on the number of Cherry Points which may be awarded to each Cherry Points account in respect of special promotional items on which additional Vodafone Points are awarded.

8.     Each credit that you accumulate will go into your Cherry Points account. The maximum Cherry points you can build up in your Cherry Points account is 10,000 over the 2 year period referred to in 14 below.

9.     Long tenure or other ‘special promotions’ are only available to selected Vodafone pay as you go customers at the invitation of Vodafone Ireland.

10.  From 6th of July 2011 until 30th of September 2011 Vodafone will run a promotion on its Cherry Points which will grant additional Cherry Points to customers based on how long they have been a Vodafone customer. The longer customers are with Vodafone the more Cherry Points they will get on every top up. Selected customers can get up to 20% extra Cherry Points on each top up based on how long they are a Vodafone customer.

11.  The number of points issued may vary between qualifying purchases. We will not exchange Cherry Points for cash.

12.  You must be a Vodafone customer at the time you try to redeem your accumulated Cherry Points. You cannot make a part payment of Cherry Points towards a product or service unless on special promotions as specified by Vodafone. You must collect the full amount of Cherry Points needed for the product you choose. These will be deducted from the total on your Cherry Points account.

13.  You will not qualify for Cherry Points on products or services purchased with Cherry Points.

14.  If you decide to return a product purchased with Cherry Points your Cherry Points account may be re-credited at the discretion of Vodafone. No cash refund will be given in these circumstances.

15.  All un-used Cherry Points accumulated need to be redeemed before 28 February of the calendar year, two calendar years after you first got them. For example:

§  Any points collected between January – December 2013 will need to be used by 28 Feb 2015.

§  Any points collected between January – December 2014 will need to be used by 28 Feb 2016 and so on.

In the case of points accumulated between November – December 2010.These points will need to be redeemed by Feb 2013.

16.  If a customer ports their number out from the Vodafone Ireland network their Points balance will be cleared down 91 days later.

17.  As per the disconnection terms and conditions if a customer has not topped up within 12 months their Cherry Points balance is cleared down.

18.  Vodafone can take any action it considers appropriate if we have reason to believe that you are abusing the Vodafone Cherry Points Scheme, including withholding Points previously credited to your Cherry Points account.

19.  The Vodafone reserves the right to modify these terms and conditions or discontinue this Vodafone Points Scheme (or any part of it) for valid commercial, technical or operational reasons, without prior notice being issued to the Customer. Members may be removed from the scheme at any time at the discretion of Vodafone Ireland.

20.  The Vodafone Cherry Points Scheme is not available with any other offer and/or promotion unless otherwise specified or redeemable as a cash or credit.

21.  If the Vodafone Cherry Points Scheme is withdrawn, any Cherry Points must be used within 2 months from the date of withdrawal or such other timeframe as Vodafone may in its sole discretion determine. Any credit not used during this period will expire.

22.  Persons registering for the Vodafone Cherry Points Scheme will be deemed to have accepted these terms and conditions.

23.  Persons entering the Vodafone Cherry Points Scheme agree to Vodafone or Vodafone Agents contacting you from time to time by post, telephone, e-mail or text message providing information on various aspects of the Vodafone products and services and the Vodafone Cherry points programme. If you do not wish to receive such details you should contact Vodafone Customer Care.

24.  Redemption of Cherry Points

25.  From July 2011, you will be able to redeem accumulated points against various products in the Cherry Points catalogue or that Vodafone makes available under the Cherry Points Scheme from time to time. Any Cherry Points used in the purchase of any item from the catalogue will be deducted from your balance.

26.  Vodafone retains the right to change any of the offered items in the catalogue at any time. However, orders placed prior to such removal shall be fulfilled to the best of the ability of Vodafone.

27.  In circumstances where items are purchased using Cherry Points and they are subsequently returned and the customer is legitimately entitled to a refund such refund shall be in the form of Cherry Points being reapplied to the customer’s account only.

28.  Vodafone further reserves the right to change the value of any item in the catalogue (in points) and may also, at any time, change the packaging and tiers of any item without notifying the customer. Cherry Points are awarded at a rate determined by Vodafone according to Vodafone set criteria.

29.  Free minutes and services earned through special offers or purchased through the Scheme do not earn points.

30.  Delivery dates are approximate. If conditions arise preventing compliance of delivery dates advised to customers, Vodafone shall not be liable for any damage or penalty for delay in delivery or the failure to give notice of the delay. In such events, delivery dates shall be extended for a period equal to such delay. 
 Where you are dealing as a consumer this does not affect your cancellation rights and other rights you may have under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. 31.  All products delivered within this program are delivered under its original manufacturer’s terms and warranties, including Vodafone branded items. All defective products are repaired or replaced at the discretion of the manufacturer. Please contact the manufacturer should you experience a problem with your new products. All gifts offered within the Scheme are subject to availability.

32.  Vodafone may set the Cherry Point value for goods and/or services at any amount, and without reference to market prices for such goods and/or services, including any other price Vodafone may offer for the same or similar goods and/or services from any shop or through any other facility operated by Vodafone or any party acting on behalf of Vodafone.

33.  Where Vodafone displays prices as a combination of Cherry Points and a monetary value then the Customer will be required to redeem the Cherry Points and pay the balance using the methods permitted by Vodafone from time to time.

34.  No cash alternative will be offered for items swapped for Cherry Points.

35.  Customers can redeem items using their Cherry Points through the following methods;online, by telephone – call free fone 1800 800 087 (top up and Vodafone bundles can only be swapped by telephone) or in any Vodafone store (handsets and modems can only be swapped in store).

36.  Each reward displayed in the Cherry catalogue has an individual Cherry Points value.

37.  Top up swapped for Cherry Points will count towards activation of any Vodafone offers a customer is signed up to such as Free calls and texts.

38.  No Cherry Points will be awarded to Top Up swapped for Cherry Points.

39.  The following additional terms and conditions apply to products purchased using Cherry Points:

40.  Top Ups – Top Ups will be applied to the number on which Cherry Points were collected and must be used in accordance with Vodafone’s general terms and conditions of its prepay service.

41.  Handsets and other mobile devices (sure signal, hands free kits, modems, mobile sharing docks, memory cards etc.) – These are for use on the Vodafone network only and may be subject to additional terms and conditions which can be found on www.vodafone.ie.

42.  Any Network Minutes and/or Texts Add Ons– Customers who avail of the Add On will be entitled to receive a bundle of call minutes and/or text messages in addition to their existing credit/free extras. Any such Add On must be used within 60 or 120 days (depending on the add on) of redemption or else any unused balance will be lost. The chosen Add Ons apply to all ROI to ROI standard calls and/or texts (as the case may be)  to any Irish Network and excludes the following:

1.             MMS or any other types of messaging medium apart from standard SMS

2.             Premium SMS messages to short codes

3.             International Text

4.             Texts to Landline

5.             Roaming Texts

6.             Fixed line calls, including Vodafone At Home

7.             International Calls

43.  Internet on your Phone Add Ons – Customers who avail of the Add On will be entitled to receive a bundle of mobile internet data in addition to their existing credit/free extras. Any such Add On must be used with 60 days of redemption or else any unused balance will be lost This Offer applies to standard mobile browsing in Ireland only and excludes roaming and video calls.

44.  Tickets for Events - Customers are responsible for ensuring that they meet the requirements to gain entry into the event and are available on the date in question. Vodafone will not be responsible for the customers inability to enter the event for any reason.

45.  When swapping Cherry Points in store you will be required to have your phone with you to allow the retail agent to call your mobile to verify your number.

46.  From January 3rd 2012 until March 31st 2012 Vodafone will run a promotion on its Cherry Points which will grant additional Cherry Points to customers based on how long they have been a Vodafone customer. The longer customers are with Vodafone the more Cherry Points they will get on every top up. Selected customers can get up to 20% extra Cherry Points on each top up based on how long they are a Vodafone customer.

47.  Any Cherry Points customer who moves from pay as you go to Billpay after the 31st December 2012 will have their Cherry Points balance cleared down on the 28th February 2014 and will be unable to use their Cherry Points

Vodafone Content Services terms and conditions

The following terms and conditions of the Vodafone content services are in addition to and form part of the General Terms and Conditions of the Vodafone Mobile Telecommunications Service. In the event of any conflict, these terms and conditions shall prevail.

The Services enable Customers to access Content (including images, sounds, video and other applications) made available to them by Vodafone (e.g. via Vodafone live! and similar portals) either by way of Downloading or by Streaming to a mobile phone, personal computer, personal digital assistant or other access device (an "Access Device").

Downloading is where a copy of the Content is installed onto the Customer's Access Device for future use by the Customer in accordance with the applicable terms and conditions.

Streaming is a live feed of data from an external source (for example from the Vodafone server) to the Customer's Access Device where no copy of the content/application is installed onto the Customer's Access Device (other than a temporary one as part of the delivery and display of that content).

Where content is delivered by way of Downloading:

1.      Customers may save the Content on their Access Device but (unless expressly permitted) are strictly prohibited from saving such Content elsewhere; and

2.     each request by the Customer to download that Content (i.e. each copy sent to them) will constitute a separate event to be paid for by the Customer at the applicable rate in accordance with the Customer's tariff plan.

Where content is delivered by way of Streaming:

1.     Customer are strictly prohibited from saving the Content on any device (including the Access Device); and

2.     each request by the Customer for that Content (i.e. each viewing) will constitute a separate event to be paid for by the Customer at the applicable rate in accordance with the Customer's tariff plan.

Customers acknowledge and accept that the Content is protected by copyright, trade mark and other intellectual property rights of Vodafone or its licensors. Customers are strictly prohibited from editing or modifying the Content, copying, distributing or forwarding the Content to one or more third parties or allowing third parties to access it.

Prior to requesting the Services, Customers should ensure that:

1.     their Access Device is compatible and appropriately enabled to receive the selected Content. If Customers are unsure whether this is the case they should check the information on www.vodafone.ie, consult their handbook or contact Vodafone customer care;

2.     (where the Content is to be Downloaded) they have sufficient memory capacity available to receive and save the Content once Downloaded;

3.     their Access Device remains switched on and connected to the Vodafone network (i.e. does not move out of range) for the duration of the Download/Streaming.

Vodafone Data Extra – (5GB data, Vodafone calls & texts)

1. The following terms and conditions of the Vodafone Data Extra Offer (the “Offer”) are in addition to and form part of the terms and conditions of the Vodafone Pay as you go Mobile Telecommunications Service and Vodafone Advantage Plus terms and conditions which are available on www.vodafone.ie. In the event of any conflict between the terms, the order of precedence shall be as follows; the terms and conditions set out below first, followed by the terms of Advantage Plus tariff and then the Vodafone Pay as you go Mobile Telecommunications Service. 

2. When you sign up to the Offer you will be automatically signing up to our Vodafone Advantage Plus tariff and Advantage Plus rates will apply after opt in. For further details of this Tariff see terms and conditions.

19.  4G will be provisioned within 48 hours of the minimum amount top up.

20.  4G cannot be used when roaming.

21.  4G is for mobile phone data use only.

22.  Connection speeds can vary with local conditions, the number of users in your area, the device you are using, and general internet traffic.

23.  A reminder will be sent via SMS to customers on the Offer towards the end of the 4 week offer period to top up to continue to avail of the Offer. Vodafone does not warrant or represent that it shall send such a reminder and it shall not be responsible for any liability incurred by Customers as a result of its failure to do so.

·         Customers can change their “for life” Offer as often as they like. When a Customer opts into a new offer, it will replace their current offer and clear down any remaining service days of their previous offer. Their new Offer will come into effect once the Customer tops up by €20 or more.

·         Where a Customer switches from a pay as you go account to a Pay Monthly account any remaining FREE calls and texts days will not be carried over.

• The following terms and conditions of the Vodafone Free Texts to any  Irish mobile network for life Offer (The “Offer) are in addition to and form part of the terms and conditions of the Vodafone Ireland Limited's ("Vodafone's") mobile telecommunications service which are available on this website.These terms and conditions will change on 15th January 2013 see the customer notification page for details. • Customers can change their “for life” Offer as often as they like. When a Customer opts into a new offer, it will replace their current offer and clear down any remaining service days of their previous offer. Their new offer will come into effect once the Customer tops up by €20 or more.
• Where a Customer switches from a pay as you go account to a Pay Monthly account  any remaining Free texts days will not be carried over.
• The Offer applies to all standard text messages only and excludes the following:

2. The Offer includes unlimited calls and texts to any network and 5GB of data for €30 credit from your top up is available from 17th February 2016.

3. This Offer is subject to a Fair Usage Policy. Vodafone has developed a threshold for the Service which is currently set at 5,000 text messages to any Irish network and 5,000 minutes to national mobiles and landlines. Vodafone does not warrant or represent that it shall send such a reminder and it shall not be responsible for any liability incurred by Customers as a result of its failure to do so.

In the event of any conflict between the terms, the order of precedence shall be as follows; the terms and conditions set out below first, followed by the terms of the Pay As You Go Mobile Telecommunications Service and the terms of the Mobile Internet last.

1. This free SIM / credit offer (the“Offer”) is only available to anyone ordering a free pay as you go SIM card through the free SIM online distribution channel. Existing terms and conditions will continue to apply to pay as you go first time connection SIM cards purchased via www.vodafone.ie or all other Vodafone channels.
2. From August 19th 2013 until such time as the Offer is withdrawn, all pay as you go first time connection SIM only connections ordered through the free SIM online distribution channel shall be entitled to avail of a €10 free credit offer.
3. To get the €10 free credit, eligible Customers must activate their account by inserting the relevant SIM card, received through the free SIM card online distribution channel, into their mobile handset and register their details online at www.vodafone.ie. Customers must register within sixty (60) days of receipt of the relevant SIM card to avail of the free credit which will be applied to the Customer’s account upon completion of registration.
4. No top up is required to avail of the Offer.
5. New Customers will receive a €0.50 credit to their account upon Account Activation irrespective of whether that new Customer then completes Registration or not.
6. The Offer is limited to two free pay as you go SIM cards per customer and each SIM issued will be linked to its registered mobile phone number. If a New Customer wishes to retain their existing mobile phone number they will not be entitled to avail of the Offer.
7. A SIM card may not be registered more than once.

Pay as you go Mobile Broadband

The following terms and conditions of Pay as you go Mobile Broadband (“Pay as you go Mobile Broadband”) are in addition to and form part of the General Terms and Conditions of the Vodafone Mobile Telecommunications Service. In the event of any conflict, the former set of terms and conditions shall prevail.

1. The price for using Pay as you go Mobile Broadband shall be as listed at the relevant charging section listed at www.vodafone.ie. This shall be inclusive of VAT at the applicable rate, unless stated otherwise.

2. A customer who avails of a pay as you go broadband data add-on (“Add-On”) will be entitled to receive a data bundle in addition to their existing tariff. Please refer to Vodafone's tariff tables for details of the number of text messages included and the associated charges. Vodafone IOU or Vodafone IOU Buddy credit cannot be used to purchase an Add-On

3. After purchasing an Add-On customers must disconnect and re-connect their internet browsing session otherwise they will continue to be charged the default rate listed above. If a customer buys an Add-On while using a separate active Add-On, the balance in that customer’s previous Add-On will be overwritten.

4. If for any reason you wish to return your Vodafone Mobile Broadband modem to the store, you can do so within fourteen days and receive a full refund on the cost of the device. Any pay as you go credit used or unused will not be refunded. In order to avail of this returns policy, the modem must not be faulty due to damage caused to it whilst in your possession and must be returned complete with proof of purchase, packaging, cables, software CD and user guide.

5. Unused data in any Add-On cannot be carried over from one period to the next.

6. A daily data Add-On shall expire at midnight of the day after the date of purchase. A weekly Add-On shall expire at midnight, 7 days after the date of purchase. A Monthly Add-On shall expire at midnight, 30 days after the date of purchase.

7. A pay as you go daily roaming add-on may only be used on Vodafone partner networks in the following countries: Austria, Belgium, Bulgaria, Croatia, Czech Republic, Denmark, Estonia, France, Germany, Greece, Hungary, Italy, Malta, Netherlands, Poland, Portugal, Slovak Republic, Slovenia, Spain, Sweden, Switzerland and United Kingdom

8. Vodafone continuously monitors network performance to ensure that the service received by customers is not impacted through a minority of users placing high demand on network resources (e.g. large bandwidths over long periods). Any such high-demand users (or users sharing data files) can expect to experience reduced speeds at peak times (typically 4pm - midnight). Peak times are subject to ongoing change based on actual network demands. This service does not support ‘calls over the internet' for any new customers or customers upgrading their tariff or equipment.

9. Mobile broadband performance is subject to network coverage and availability. Unless otherwise stated any speeds referenced are maximum achievable speeds and actual broadband speed may vary based on a number of factors. A speed cap may be imposed on this tariff plan.

10.  Vodafone reserves the right to offer priority to users on other preferential tariffs in priority to this tariff plan.

11.  Vodafone reserves the right to withdraw Pay as you go Mobile Broadband generally or from any particular Customer at any time, and to vary or amend any element of Pay as you go Mobile Broadband without further notice. These terms and conditions may be varied or amended by Vodafone for any valid commercial technical or operational reason.

Pay As You Go Porting Offer

• A €20 discount off the purchase of a handset greater than €39.99 is available to any customer switching from another network to Vodafone Pay As You Go.
• This offer includes customers switching from either post pay or pay as you go on another network to Vodafone Pay As You Go.
• This discount cannot be used in exchange for top up, accessories or any other product or service.
• This porting offer is subject to purchasing a handset with Vodafone on Pay As You Go and excludes Vodafone Postpay.
• Vodafone reserves the right to amend or change this offer at any time.

Pay As You Go RED

·        These terms and conditions of pay as you go RED are On Demand Terms and Conditions. You are advised to check the most up to date prices and terms and conditions associated with this service before using this service. Vodafone reserves the right to alter any of these terms and conditions for legal, technical, operational or commercial reasons without further notice to the Customer.

·         Customers can purchase pay as you go RED when they have the required credit balance.

·         Pay as you go RED is a non-recurring bundle.

·         Customers who have an active pay as you go RED bundle cannot purchase a stand-alone talk, text or data add on whilst they have a remaining allocation of calls, texts or data on RED.

·         The benefits of RED last up to 28 days from the purchase date after which they will expire if unused.

·         There is no carryover of unused elements if another RED bundle is purchased during the 28 days.

·         Customers with an active pay as you go RED bundle can make free calls to pay as you go Customer care (1747) from the Rep. Ireland. Otherwise, a charge of 15c per call applies.

·         Customers who purchase pay as you go RED will remain on their existing tariff and topup offers and are bound by the terms and conditions of those.

·         Customers with Vodafone Cloud and Vodafone Protect are bound by the terms for those services.

·         Customers who are opted into Cherry Points will receive 60 bonus Cherry Points when they purchase PAYG RED. These will be applied within 72 hours of purchase of RED. Please refer to terms and condition of Cherry Points

·         Pay as you go RED is subject to a Fair Usage Policy. The fair usage limits for pay as you go RED are outlined below

·         Any usage over these limits will be charged at standard rates as per customer’s tarif.

·         Inclusive texts apply to texts to Irish mobiles in the Republic of Ireland only. Excludes texts to landlines, international texts, premium rate texts & picture messages.

·         The 1GB data allowance can be used to access the internet via the below APN’s only: Wap.vodafone.ie & Live.vodafone.com

·         PAYG RED elements of inclusive calls, texts and mobile data cannot be used when roaming.

·         The Offer will not apply to, and may not be used, in conjunction with Prolinks, Sim boxes or any related device which diverts / transfers calls to multiple mobile numbers and Vodafone reserves the right to terminate the Offer and / or the pay as you go mobile telephony service provided by Vodafone to you (the “Service”) without notice where it appears to Vodafone that you use, or have used, the Service in this or in any related manner.

Scheduled Top-Up Services

1. Automatic top up and Scheduled Gifting (“Automatic top up Service(s)”) are available to Customers registered with the Service. You may set up a Scheduled Top Up Service whereby you add credit to either your own PAYG Vodafone mobile (“Automatic top up”) or you add credit to another Vodafone PAYG mobile (“Scheduled Gifting”). This can be set up so that the Top Up is applied on the same day each week, same date each month or every recurring 30 days.
2. To avail of and register for an Automatic top up Service you must have an Irish mobile number with a Caller Line Identification (CLI) number. To register you must contact us outlined above at Clause 2. You do not have to be a Vodafone Customer to use the Automatic top up service. Only one (1) Automatic top up can be set up per mobile number.
3. You acknowledge that funds will be automatically deducted from your selected payment card and credited to the registered Vodafone Direct Top Up account when Top-Up is ordered through the Automatic top up Services on the same day each week, date each month and on a rolling basis until and unless you cancel your Scheduled Top Up in accordance with Clause 6 below.
4. Once you have successfully set up Automatic top up, we will send you a text message to notify you that your registration was successful. This will be followed by a further text message on the day or date selected you selected your account to be Topped Up to confirm the Automatic top up amount credited to your registered Top Up account.
5. Once you have successfully set up Scheduled Gifting, we will send you a text message to notify you that your registration was successful. Each time the phone you set up to receive the scheduled gifted credit (“giftee”) is topped up you will receive an SMS to state the Top Up amount you sent to the Giftee and how much was deducted from your payment card. We will only send the person you registered a text message to notify them of the amount credited to their mobile phone on the day or date you selected.
6. To amend or cancel your Automatic top up Service, you must give Vodafone a minimum of 24 hours notice, by contacting us on 1747 or 1850-995-087 or via the web and advising our CSR’s that you wish to amend or cancel your Scheduled Top Up Service, before this will be applied and take effect to your registered Direct Top Up account.
7. Vodafone operates this Service in conjunction with a third party service provider (Vesta Payment Solutions Ltd). You acknowledge and accept that Vodafone and its associated third parties must collect personal data, including without limitation credit information from you to register and use the Service and Scheduled Top Up Services. You acknowledge and expressly consent that Vodafone and its associated third parties may collect, process and disclose your personal data, including without limitation disclosing your registered mobile number to your giftee via SMS to notify them of their Scheduled Gift or Once off Top Up Gift. Vodafone and its associated third parties will always process your personal data in strict accordance with the Data Protection Acts 1988 and 2003.
8. Vodafone will not be liable or responsible to you or any third party for any loss or damage you may suffer in relation to your use of this Service and the acts or omissions of our third party service providers, agents or contractors, including without limitation the processing of customer refunds via the Service. As the registered account owner of that mobile number you are only authorized to set up, amend and otherwise cancel the Service or Automatic top up Services and therefore, accept sole full responsibility for using the Service and Scheduled Top Up Services in accordance with these terms and conditions and hence, keeping your account details and Top Up Codes and Usernames/Passwords safe and secure from loss or theft. In addition, Vodafone will not be liable or responsible for any failure in the Service that may arise as a result of any power disruption or technical fault.

Vodafone reserves the right to vary or amend these terms and conditions of the Service in whole or part at any time, where in its opinion there is a valid commercial, technical or operational reason. Vodafone will endeavour to give you reasonable prior notice of any changes to the Service, or its terms and conditions, however please continually check our website for updates to these terms and conditions, as your continued use of this Service will be taken as acceptance of any future changes.

Pay As You Go Spotify Premium Bundle

·         If you are a Vodafone PAYG customer with a Spotify compatible smartphone you can purchase Spotify Premium bundle for a monthly charge as set out in the Vodafone tariff sheet which can be found online at www.vodafone.ie.

·         This fee will be deducted from your PAYG call credit balance on a rolling monthly basis, from the date which you first subscribed for the bundle. If you do not have sufficient credit in your account then you cannot purchase or avail of the service. Vodafone will try to debit your account with the monthly fee for a period of five days after your monthly subscription date. You will be automatically unsubscribed from the service if you do not have sufficient credit in your account within five days of your monthly renewal date. Customers can unsubscribe from the service at any time.

·         If a customer purchases the Spotify Premium bundle they receive an additional data allowance of 500MB. The monthly data allowance expires 30 days from the date that the Customer purchases the Add On.

·         The additional monthly data allowance can be used to access the internet via the below APN’s only: Wap.vodafone.ie // Live.vodafone.com

·         Your additional data allowance may be used for both Spotify Premium data usage and regular domestic data usage.

·         In order to commence using Spotify, you must register and accept the Spotify Terms and Conditions of the Spotify service. These terms and conditions govern your use of the Spotify service. A link to the sign up facility for Spotify containing terms and conditions will be provided to you via SMS and these terms will be binding between you and Spotify.

·         The Spotify service is an independent third party content service, provided by Spotify Limited. Vodafone is not responsible for, nor accepts any liability whatsoever in relation to the provision of the Service and/or its content by Spotify, or its use by Vodafone customers. By signing up to a Spotify Premium bundle, you understand and expressly agree that Vodafone is not responsible for the provision of the Spotify service to you. If you do not agree with this term then please do not use the service.

·         Vodafone cannot guarantee that Spotify will be compatible with all smartphones and you are advised to check your smartphone’s compatibility with Spotify before you purchase it.

·         Vodafone will need to contact you from time to time in relation to the operation and administration of the Spotify Service. By signing up to these terms and conditions you explicitly agree that we may contact you for these purposes in relation to the Spotify Service.

·         Customers are only entitled to one Spotify Premium bundle per month.

Pay As You Go Spotify Premium Bundle

·         If you are a Vodafone PAYG customer with a Spotify compatible smartphone you can purchase Spotify Premium bundle for a monthly charge as set out in the Vodafone tariff sheet which can be found online at www.vodafone.ie.

Vodafone Top Me Up terms and conditions

1. These terms and conditions set out the basis upon which the Top Me Up service (the “Service”) will be made available by Vodafone Ireland Limited of Mountainview, Leopardstown, Dublin 18 (“Vodafone”) to the Customer and are in addition to and form part of the terms and conditions of the Vodafone mobile telecommunications service. In the event of any conflict the terms and conditions below shall prevail.

2. This Service is immediately available to all bill paying customers with the exception of Small to Medium Enterprise [SME] and Corporate customers in which case authorisation must be obtained via the account holder.

1.             Post Pay Customers must be connected to the Vodafone Network for a period greater than six months and

2.             The billing account of the Post Pay Customers must not be outstanding and the Post Pay Customer must have credit rating acceptable to Vodafone.

Where the Post Pay Customer attempting to use the Service does not satisfy the these criteria any requests or orders for a Top-Up to a Pay as you go Customer shall not be processed.

3. The Service allows Post Pay Customers to credit additional mobile credit to the pre-paid account of any eligible pre-paid subscribers to the Vodafone network (“Pay as you go Customers”) in specified Euro denominations (a “Top-Up”).

4. The Service can be used either on a once-off basis or as a scheduled regular top-up service.

5. The cost of the Service is the amount of the Top-Up which the Post Pay Customer requires to be credited to the Pay as you go customer’s account under the Service. Top-Ups may be requested in amounts of any denomination of €10, €20 and €40 [up to a maximum limit].

6. For once-off Top-Ups the Customer will be required to send the Top-Up request to 50228. The Top-Up request must consist of the mobile phone number of the Pay as you go Customer to which the Top-Up is to be granted along with the amount of the Top-Up. The Post Pay Customer will then receive a confirmation text message containing confirmation of the mobile phone number to which the Top-Up is to be granted and the amount of the Top-Up along with a unique ID code.

7. To complete the Top-Up the Post Pay Customer is required to reply to the confirmation text message with the unique ID code. If the unique ID code is not used within 24 hours of receipt it will expire.

8. Post pay customers may also use the Service on a once-off basis by accessing the My Vodafone website. The Customer will be required to provide the mobile phone number of the Pay as you go Customer to whom he or she wishes to grant the Top-Up and the amount of the Top-Up which will be credited to that customer’s pay as you go account.

9. Customers may also use the Service to schedule regular Top-Ups of mobile phone credit to a specified mobile phone number or numbers (to a maximum of 5 different mobile phone numbers). In order to use the Service in this way Customers must access the My Vodafone website and register the mobile phone numbers of the Pay as you go Customer and the amounts of the Top-Ups. The Customer may also decide the frequency of the scheduled Top-Ups (i.e. weekly, fortnightly or monthly).

10. Once a Top-Up request has been placed whether by text message or through the My Vodafone website it will be processed immediately and can not be cancelled. However Customers may at any time cancel any of the regular scheduled Top-Ups by accessing the My Vodafone website in advance of the time of the scheduled Top-Up and amending the details thereon. 
 Where you are dealing as a consumer this does not affect your cancellation rights and other rights you may have under the European Union (Consumer Information, Cancellation and Other Rights) Regulations 2013. 11. Customers will be informed by text message when the Top-Up has been delivered to the relevant Pay as you go Customer. This message will include details of the amount of the Top-Up granted and the mobile phone number to which it has been granted.

12. The maximum amount of mobile phone credit (whether as a once-off Top-Up or regular scheduled Top-Up) which can be credited to Pay as you go Customers under the Service by an individual Post Pay Customers in any one calendar month will be at the sole discretion of Vodafone.

13. Pay as you go customers who do not want to receive Top-Ups may opt-out from the Service by contacting the Customer Care helpline 1747 (from a mobile) or 1850 20 40 20 (from a landline). Pay as you go Customers may also opt-out from the Service through registering on the My Vodafone website and www.vodafone.ie.

14. Customers using the Service will be billed the amount of the Top-Up granted to a Pay as you go Customer directly to their Vodafone account at the time of the delivery of the mobile phone credit to the Pay as you go Customer. Post Pay Customers using the Service will not be charged for text messages sending the Service Order unless the Customer is utilising Vodafone’s roaming service abroad in which case the charges will be as set out by the relevant network provider.

Important Note about the Post pay customers bill:

The billing for Top Me Up is processed in real time, so when a Top Up is applied to a Pay as you go customer - whether once off or scheduled - the Top Up amount is debited to the Post pay customer's account immediately i.e. on the next Direct Debit date even if a bill has already been issued. The reason for this is to avoid double counting VAT on your bill.

Example:

A Postpaid customer is on a Direct Debit schedule to pay his Vodafone bill, the due date is 10th March He receives a bill for €50 on 7th March The customer Tops Up his son with €10 credit on 8th March On 10th March, his Direct Debit date, a total of €60 is taken from his bank account i.e. the original bill amount of €50 plus the €10 Top Up.

15. By using the Service Post Pay Customers are deemed to consent to the disclosure by Vodafone of their mobile phone number to the holder of the mobile phone number to which the Top-Up is granted.

16. Insofar as it is permissible by law, Vodafone shall not be liable for any injury, loss or damage, whether foreseen or unforeseen, directly resulting from:

1.             any failure, interruption, delay, suspension or restriction in providing the Service to the Customer which is due to any act of God, government control restrictions or prohibitions, any other act or omission of any public or regulatory authority (whether local, national, international or supranational), an act of default of any supplier, agent or other person, strikes, work stoppages or labour disputes or any other cause whatsoever which is beyond the reasonable control of Vodafone;

2.             any claim arising out of any act or omission by the Customer, its servants or agents or arising out of any reliance placed by such persons on the Service;

3.             any valid suspension of the Service.

17. Vodafone reserves the right to withdraw the Service generally or from any particular customer at any time and to vary or amend any element of this Service at any time without further notice. These terms and conditions may be varied or amended by Vodafone for any valid commercial technical or operational reason.

18. Vodafone may, without notice, suspend the availability of the Service to the Customer wholly or partially for any valid reason, including without limitation, where:

1.             the Customer fails to pay Vodafone any sums due under any other contract with Vodafone on the due date specified in an invoice, notwithstanding the issue of any invoices thereafter; or

2.             Vodafone reasonably believes that the Customer is unable to comply with payment obligations, represents a credit risk or if Vodafone is unable to contact the Customer following reasonable efforts; or

3.             the Customer fails to observe any term or obligation set out herein or any relevant law.

19. Vodafone shall exercise such reasonable skill and care in the provision of the Service as may be expected of a reasonably competent mobile telecommunications operator. Except as expressly provided in these terms and conditions, all conditions, terms, warranties and representations whether express or implied by law in relation to the provision of the Service are excluded to the fullest extent permitted by the applicable law.

Vodafone PAYG €5 Add Ons

1. The following terms and conditions of the Vodafone Pay As You Go €5 Add Ons are in addition to and form part of the terms and conditions of the Vodafone Pay As You Go Mobile Telecommunications Service which are available on www.vodafone.ie. In the event of any conflict between the terms, the order of precedence shall be as follows; the terms and conditions set out below first, followed by the terms of the Vodafone Pay As You Go Mobile Telecommunications Service. 

2. Vodafone Pay As You Go customers can choose to purchase more minutes, international minutes, texts or data for a thirty day period at an additional cost:

1.             30 voice minutes; or

2.             30 international voice minutes; or

3.             100 domestic texts; or

4.             500MB;

(each an “Add On”). 

3. Each Add On will cost €5. These Add Ons can be updated from month to month, with no restriction.

4. Customers cannot purchase more than one of each type of Add On at any one time.

5. Customers can purchase another of the same type of Add On when the existing Add On allocation is used. They are non-recurring.

6. The benefits of these Add Ons last up to 4 weeks after which they will expire if unused.

7. A subsequent Add On can only be purchased within the 4 weeks if there is no minute, text or data allocation remaining in your current Add On

8. These Add Ons exclude usage when roaming.

9. The voice Add On includes calls to Irish mobile and landlines in the Rep. of Ireland only. Excludes international, voicemail, premium rate & calls to directory enquiries services.

10.  The data Add On can be used to access the internet via the below APN’s only: Wap.vodafone.ie & Live.vodafone.com

11.  4G data is not available with the data Add On.

12.  The text Add On includes texts to Irish mobiles in the Rep.of Ireland only. The text Add On cannot be used to text landlines. Also excludes premium rate SMS, international SMS & picture messages.

Vodafone €5 Top Up

Please note the €5 top is only available at selected Vodafone retail outlets.

Vodafone reserves the right to withdraw the €5 Top Up either generally or in respect of any particular customer at any time and to vary or amend any element of the scheme at any time without further notice.

Vodafone BlackBerry Pay As You Go ® Service

The wireless communications solution supplied by Vodafone providing “push” access to email and other data services via a qualifying BlackBerry ® device or device that supports the service on a Vodafone Ireland Pay As You Go (PAYG) subscription (the Vodafone BlackBerry ® PAYG Service) . BlackBerry®, RIM®, Research In Motion®,SureType®, SurePress™ and related trademarks, names and logos are the property of Research In Motion Limited and are registered and/or used in the U.S. and countries around the world. Used under license from Research In Motion Limited.

BlackBerry® PAYG Terms and Conditions

1. The following terms and conditions of the Vodafone BlackBerry® PAYG Service are in addition to the terms and conditions applicable to any add-ons and form part of the PAYG general terms and conditions of the Vodafone Ireland Limited ("Vodafone") mobile telecommunications service. In the event of any conflict these terms and conditions below shall prevail. The Vodafone BlackBerry ® PAYG Service is only available to PAYG mobile customers of Vodafone ("Customers") who have met these conditions and allows Customers access to the Vodafone BlackBerry ® PAYG Service (subject to these terms and conditions) via their mobile phone account (the “Vodafone BlackBerry ® PAYG Tariff”).

2. The Vodafone BlackBerry ® PAYG Service is available only to Pay as You Go customers of Vodafone and will automatically be applied to any customer who accesses the Vodafone BlackBerry ® PAYG Service via a BlackBerry ® device or device that supports the service. The customer must also have a qualifying BlackBerry ® device or device that supports the service. The daily charges set out herein will automatically be deducted from the customer’s outstanding credit. The service will not be available if the customer does not have adequate credit to pay the daily charges. Vodafone may in its sole discretion at any time restrict the service to those that have topped up by a certain amount in any 30 day period (e.g. €20). You must meet these criteria to avail of the Service.

3. Use of the BlackBerry Access Point blackberry.net (APN) which provides access to email, external websites, BlackBerry Messenger, social networking apps and other BlackBerry ® supported data services either on a BlackBerry device or a device that supports the BlackBerry data, requires the customer to have signed up for the Vodafone BlackBerry ® PAYG Service and to have met the conditions set out herein. A session starts when a customer first connects to the Vodafone BlackBerry PAYG ® Service and ends when a customer disconnects from the Vodafone BlackBerry PAYG ® Service. The BlackBerry® browser icon or any specific application browser icon loaded on the customer’s BlackBerry® at the time of purchase must be used to access the internet to ensure data usage is taken out of the included data awarded with the PAYG tariff. Accessing the mobile internet through any other icon such as Vodafone live! will be charged at €1.99 for 100MB allowance

4. The data allowance can be used to access any webmail account supported by the BlackBerry ® Internet service (including Yahoo!, Hotmail, Gmail and POP3/IMAP) only.  BlackBerry® Enterprise Service for Corporate Email accounts is not permitted on the Vodafone BlackBerry ® PAYG Service.  Accessing any non-BlackBerry data service from the device, such as using the phone as a tethered modem may also attract additional charges.

5. In addition to the terms and conditions set out herein in relation to use of the Vodafone BlackBerry® PAYG Tariffs, RIM’s standard terms and conditions associated with the use of BlackBerry® from Vodafone and the BlackBerry® Internet Service and other associated products will also apply to use of these products and services.

6. All prices, tariffs and credit expiry periods are current as of August 2011 and are subject to change.

7. Vodafone BlackBerry ® PAYG Service customers will only be able to avail of the BlackBerry ® Internet Service or BIS, access to BlackBerry ® Enterprise Service (BES) is not permitted.  If the customer gets access to the BlackBerry ® Enterprise Service, determined by the customers profile on the RIM Relay, Vodafone can change the status back to BIS without notice to the customer.

8. Inserting a Pay as You Go SIM into a BlackBerry ® device may incur the BlackBerry daily data charge, regardless of the customer activating any email/data messaging or any other BlackBerry data services on the device.  The customer will be liable for a daily charge of €1.99. €1.99 for 100MB allowance.

9. A Vodafone BlackBerry ® PAYG Service customer will incur a daily charge of €1.99 for data transmitted or received on the device via the blackberry.net and Vodafone Live APN.  Data will typically be transmitted by using the BlackBerry services including but not solely email, instant messaging, social networking and App store.

10.  The daily charge will be incurred if the customer has credit on their pay as you go balance and blackberry.net data is transmitted to or from the device either actively or passively by the user.

11.  In order to disable the blackberry.net service and related charging the customer will need to contact Vodafone Care and ask to be removed from the service. 

12.  A BlackBerry ® PAYG customer who has not used any blackberry.net APN data traffic for a period of 30 days can be removed from the service without notice by Vodafone.

Vodafone IOU

These terms and conditions set out the basis upon which the Vodafone Pay as you go IOU Service promotion (the "IOU Service") will be made available by Vodafone Ireland Limited of Mountainview, Leopardstown, Dublin 18 ("Vodafone") to the Customer and are in addition to and form part of the terms and conditions of the Vodafone mobile telecommunications service. In the event of any conflict the terms and conditions below shall prevail.

This IOU Service is available only to eligible pre-paid subscribers to the Vodafone network ("Pay as you go Customers") and who meet the following eligibility criteria:

• Customers must have topped up their mobile phone account within the last three months.
• Customers must have either made or received a call within the last three months.

Where the Pay as you go Customer attempting to use the IOU Service does not satisfy these criteria any requests or orders for the IOU Service shall not be processed.

The IOU Service allows Pay as you go Customers to request an advance of mobile phone credit in the amount of €2 (the "IOU Credit") to their Pay as you go account which amount shall be deducted from their mobile credit account at the time they next add credit to their account ("Top-Up").

Customers must text the phrase "IOU" to 50223 in order to request the IOU Service.

The cost of the IOU Service is the cost of the text message which will be the text sent to the Customer by Vodafone when they next top up notifying the Customer of the provision of the IOU Credit at a charge of €0.15.

At the time of the next Top-Up of the Customer's Account the initial charge of €0.15 will be deducted from the Customer's Account along with the amount of the IOU Credit which has been used by the Customer. This charge will only be incurred by the Customer where the Customer has used part or all of the IOU Credit.

Once a text request for the IOU Service has been placed whether it will be processed immediately and can not be cancelled.

Customers will be informed by text message when the IOU Credit has been delivered to their account. This message will include details of the amount of the IOU Credit granted.

Customers may only avail of the IOU Service on one occasion before they next Top-Up after which time the Customer will be allowed to use the IOU Service again.

Insofar as it is permissible by law, Vodafone shall not be liable for any injury, loss or damage, whether foreseen or unforeseen, directly resulting from:

• any failure, interruption, delay, suspension or restriction in providing the IOU Service to the Customer which is due to any act of God, government control restrictions or prohibitions, any other act or omission of any public or regulatory authority (whether local, national, international or supranational), an act of default of any supplier, agent or other person, strikes, work stoppages or labour disputes or any other cause whatsoever which is beyond the reasonable control of Vodafone;
• any claim arising out of any act or omission by the Customer, its servants or agents or arising out of any reliance placed by such persons on the IOU Service;
• any valid suspension of the IOU Service;

Vodafone reserves the right to withdraw the IOU Service generally or from any particular customer at any time and to vary or amend any element of the IOU Service at any time without further notice. These terms and conditions may be varied or amended by Vodafone for any valid commercial technical or operational reason.

Vodafone may, without notice, suspend the availability of the IOU Service to the Customer wholly or partially for any valid reason, including without limitation, where:

• the Customer fails to pay Vodafone any sums due under any other contract with Vodafone on the due date specified in an invoice, notwithstanding the issue of any invoices thereafter; or
• Vodafone reasonably believes that the Customer is unable to comply with payment obligations, represents a credit risk or if Vodafone is unable to contact the Customer following reasonable efforts; or
• the Customer fails to observe any term or obligation set out herein or any relevant law.

Vodafone shall exercise such reasonable skill and care in the provision of the IOU Service as may be expected of a reasonably competent mobile telecommunications operator. Except as expressly provided in these terms and conditions, all conditions, terms, warranties and representations whether express or implied by law in relation to the provision of the IOU Service are excluded to the fullest extent permitted by the applicable law.

Vodafone IOU Buddy

These terms and conditions set out the basis upon which the Vodafone Pay as you go IOU Buddy Service promotion ("IOU Buddy") will be made available by Vodafone Ireland Limited of Mountainview, Leopardstown, Dublin 18 ("Vodafone") to the Customer and are in addition to and form part of the terms and conditions of the Vodafone mobile telecommunications service. In the event of any conflict the terms and conditions below shall prevail.

1. This IOU Buddy Service is available only to eligible pre-paid subscribers to the Vodafone network ("Pay as you go Customers") who are opted into this service.

2. Please note, IOU Buddy does not operate in conjunction with any other Top Up offer by Vodafone. Received credit does not count as a Top Up.

3. Where the Pay as you go Customer attempting to use the IOU Buddy does not satisfy these criteria any requests or orders for the IOU Buddy shall not be processed.

4. The IOU Buddy allows Pay as you go Customers to request and transfer mobile phone credit to and from other Pay as you go Customers. There is a service charge of €0.15c for a transfer which will be charged to the customer who receives mobile phone credit to their account once the transfer is complete.

5. To request a credit transfer, a customer should text “Ask”, followed by the potential donor’s mobile number, to 50223. There is no onus upon the requested customer to respond and this request service is free for both customers.

6. A donating customer must text "Send", followed by the recipient’s mobile number and the requested amount, to 50223 in order to make a credit transfer.

7. Vodafone will notify the customer by text message that they have received an IOU Buddy Credit at a charge of €0.15. The donor will also be notified free of charge that the donation was successful.

8. Once a text request for the IOU Buddy service has been placed, it will be processed immediately and cannot be cancelled.

9. Customers may only avail of the IOU Buddy service based on the following limitations: 

• A customer can only make 4 donations every 7 days 
• A customer can only receive 4 donations every 7 days 
• A customer can only make 4 requests every 7 days 
• A customer can only receive a maximum of €40 every 7 days 
• A customer can only send a maximum of €40 every 7 days 
• A customer can send any amount between €2 - €20 per transaction 
• A customer can only donate to the same number once every 4 hours 
• A customer can only request a transfer from the same number once every 4 hours  

10.  Insofar as it is permissible by law, Vodafone shall not be liable for any injury, loss or damage, whether foreseen or unforeseen, directly resulting from: 

• any failure, interruption, delay, suspension or restriction in providing the IOU Buddy Service to the Customer which is due to any act of God, government control restrictions or prohibitions, any other act or omission of any public or regulatory authority (whether local, national, international or supranational), an act of default of any supplier, agent or other person, strikes, work stoppages or labour disputes or any other cause whatsoever which is beyond the reasonable control of Vodafone;

 Vodafone reserves the right to withdraw the IOU Buddy Service generally or from any particular customer at any time and to vary or amend any element of the IOU Buddy Service at any time without further notice. These terms and conditions may be varied or amended by Vodafone for any valid commercial technical or operational reason. 

 Vodafone may, without notice, suspend the availability of the IOU Buddy Service to the Customer wholly or partially for any valid reason, including without limitation, where: 

• the Customer fails to pay Vodafone any sums due under any other contract with Vodafone on the due date specified in an invoice, notwithstanding the issue of any invoices thereafter; or 
• Vodafone reasonably believes that the Customer is unable to comply with payment obligations, represents a credit risk or if Vodafone is unable to contact the Customer following reasonable efforts; or 
• the Customer fails to observe any term or obligation set out herein or any relevant law.

These terms and conditions set out the basis upon which the Vodafone Pay as you go Super IOU Service promotion (the "Super IOU Service") will be made available by Vodafone Ireland Limited of Mountainview, Leopardstown, Dublin 18 ("Vodafone") to the Customer and are in addition to and form part of the terms and conditions of the Vodafone mobile telecommunications service. In the event of any conflict the terms and conditions below shall prevail.

This Super IOU Service is available only to eligible pre-paid subscribers to the Vodafone network ("Pay as you go Customers") and who meet the following eligibility criteria:

·         Customers must have topped up their mobile phone account within the last three months.

·         Customers must have either made or received a call within the last three months.

Where the Pay as you go Customer attempting to use the Super IOU Service does not satisfy these criteria any requests or orders for the IOU Service shall not be processed.

The Super IOU Service allows Pay as you go Customers to request an advance of mobile phone credit in the amount of €4 (the "Super IOU Credit") to their Pay as you go account which amount shall be deducted from their mobile credit account at the time they next add credit to their account ("Top-Up").

Customers must text the phrase "Super" to 50223 in order to request the Super IOU Service.

Once a text request for the Super IOU Service has been placed whether it will be processed immediately and can not be cancelled.

Customers will be informed by text message when the Super IOU Credit has been delivered to their account. This message will include details of the amount of the Super IOU Credit granted.

Customers may only avail of the Super IOU Service on one occasion before they next Top-Up after which time the Customer will be allowed to use the Super IOU Service again.

Pay as you go "Vodafone Lifestyle" tariff

The following terms and conditions of the Pay as you go "Vodafone Lifestyle" Tariff ("the Tariff") are in addition to and form part of the terms and conditions of the Vodafone Ireland pay as you go mobile telecommunications service. In the event of any conflict, the terms and conditions below shall prevail. The Tariff is available only to customers of the Vodafone Pay as you go GSM service who register for the Tariff and do not participate in any other Vodafone discount scheme ("Customers"). 

Customers may register for the Tariff:

·         On the web: Visit www.vodafone.ie and log onto the My Vodafone section

·         In store: Call into any Vodafone store

·         By telephone: call the Vodafone helpdesk number 1747 (from a mobile) or 1850 20 40 20 (from a landline). Calls charged at €0.147 per call

·         Customer will not be able to change from this tariff to Vodafone Social Life or Work and Leisure, as both these tariffs are legacy tariffs.

·         A call set-up fee of 9c applies to all connected calls.

·         Calls charged on a per second basis, unless otherwise stated. The tariffs are displayed here at 2 decimal places for information purposes.

·         FREE Voicemail allows you to access your Vodafone Voicemail through 171. You will need to be Topped Up (min. 1 cent) and within your service period to access your Vodafone Voicemail.

·         Off Peak rates include Public Holidays. Please note Good Friday is not a Public Holiday.

Vodafone Online, IVR and SMS Top-Up Terms and Conditions

1. The following terms and conditions form part of Vodafone’s Top-Up Online, IVR and SMS Service (“the Service”). Vodafone’s general terms and conditions, to which you have also agreed to are available at http://www.vodafone.ie/terms/prepay#generalFrom130611 combined with these terms below constitute a legally binding agreement between Vodafone (“we/us”, “Vodafone”) and the Customer (“you/the Customer”) for the use of the Service.

2. This Service enables Customers to directly add credit (“Top-Up”) to a Vodafone Pay As You Go (“PAYG”) mobile via permitted payment cards  listed below This Service can be used from a Vodafone mobile by calling 1747, texting “Top Up” to50277 followed by the amount you wish to Top-Up and the last four digits of your payment device, calling 1850-995-087 from all other fixed and mobile services or by visiting http://www.vodafone.ie/myv or  https://topup.vodafone.ie/VodafoneIEExternalWeb/enter.do

3. If you wish to use this Service you must first register your payment details via 1747 or 1850-995-087 or via the website to set–up an account for the Service whereby you will register your payment card (i.e. your credit/debit card details) and for your security create a unique Top Up Code (PAYG Customers on IVR) or create a User Login/Password (Web).

4. You must always provide your payment details, mobile phone number and Top Up Code (IVR customers) or Username password (Web) to access and Top Up a Vodafone PAYG mobile. Please note, after three (3) failed attempts to enter an incorrect Top Up Code or Username/Password you will be locked out of your Direct Top Up account whereby you must call us on 1747 or 1850-995-087 to verify and confirm your identity and account details for further access. We will reset your Top-Up Code (IVR) or you can request a temporary password (Web), however for your security and fraud reasons, it is your responsibility to change this immediately.

5. Once you have successfully registered for the Service, funds will be automatically deducted from your selected payment card and credited to the applicable Vodafone PAYG mobile when Top-Up is ordered through this Service.

6. The minimum Top-Up amount allowed in one transaction is €10.00. The maximum Top-Up amount allowed in one transaction is €100.00

7. You may use the following types of payment cards to Top-Up a Vodafone PAYG account:

1.             VISA (all countries);

2.             MasterCard (all countries); and

3.             Laser/Debit Card (Republic of Ireland only)

Until further notice, you cannot use any other payment cards with this Service.

8. Top Up credit is non-refundable, non-exchangeable and non-transferable.

9. Calls to 1747 from Vodafone mobiles to access the Service cost 15c per call . Standard roaming rates will apply to calls to the 1747 Service number made whilst roaming. See www.vodafone.ie for full details as to our roaming rates and charges. 
 SMS to 50277 is provided free of charge within the Republic of Ireland and selected countries whilst roaming. 

You are advised that the Service may not be available whilst roaming in certain countries. The countries with which Vodafone has roaming agreement are listed on www.vodafone.ie. 

Call charges also apply for calls to the Service using the 1850-995-087number, which is only accessible within the Republic of Ireland. Callers from a landline will pay 2.6c per min during peak times, 1.4c per min off peak. Callers from a mobile will pay 23.4c per min during peak times, 15.8c per min off peak.

Vodafone World terms & conditions (Pay as you go)

1. Vodafone World tariff tables are designed as a guide for you to calculate your roaming charges. All prices are displayed in Euro per minute and are accurate as of 1st July 2014, but may change without notice.

2. All Vodafone World voice and text rates displayed are inclusive of VAT at 23% as displayed on https://www.vodafone.ie/roaming/calls-texts/

3. It is Vodafone's policy not to charge Customers for diverted voicemail calls received by Customers while roaming internationally. However, there may be rare occasions where, due to circumstances beyond Vodafone's control, this technically will not happen and Customers will be charged for diverted voicemail. In such circumstances, upon receipt of a request from a Customer, Vodafone will reimburse the entire amount charged for such diverted voicemail calls.

4. In Vodafone World Europe zone making a call will be subject to a minimum charge of 30 seconds and thereafter will be charged on a per second basis. Receiving a call in Vodafone World Europe zone will also be charged on a per second basis. When roaming in Vodafone World USA & Canada and Rest of World zones you will be charged on a per minutes basis for both making and receiving calls.

5. Vodafone World rates apply to GSM networks only.

6. Charges for premium rate and satellite calls will vary according to the cost charged by the foreign network operator and exchange rate fluctuations, and may include minimum call charges. A network handling fee will be applied to these calls

7. Vodafone cannot guarantee access to our coverage within any foreign country. If you are unable to receive access to a Vodafone Preferred Network, you may obtain access to another foreign network operator in that country. If so, you will be charged accordingly.

8. These terms and conditions are in addition to the general terms and conditions of the Vodafone service.

16. The 20GB data allowance can be used to access the internet via the below Access Point Networks only: wap.vodafone.ie & live.vodafone.com. Tethering over the HS APN or any other use of the HS APN will incur OOB charges.
17. Vodafone X elements of inclusive calls, texts and mobile data cannot be used when roaming.
18. There is no carry forward of unused benefits if you change top up offers or complete a new minimum amount top up before your 4 weeks Offer period expires.
19. If you switch from pay as you go to Vodafone post-pay, no part or element of this Offer will be carried over.
20. The Offer is available through the following channels:
    1. Existing customers can sign up to the Offer via Online or Vodafone stores. Customers will be asked to log on through Facebook to be eligible to sign up Online, or to present a valid ID into store to prove there are students.     2. First time connections or customers porting in to Vodafone PAYG can sign up to the Offer by visiting any of our Vodafone stores and presenting a valid ID into store to prove there are students. A new PAYG customer cannot sign up Online.
    3. Once a customer becomes a Vodafone X customer they can change their Vodafone X offer through the Vodafone App or in store at any time.
    4. Irish Student Card issued by a 3rd level college in Ireland, in date with photo embedded is accepted.
21. Opting into any other Vodafone offer after signing up to Vodafone X will cancel this offer automatically.
22. Vodafone IOU services are not available on this Offer. A customer will be unable to opt into the Offer if they currently have an IOU service active – a top up will be needed before opt in to clear the outstanding balance. Once opted into the Offer the IOU service will not be available.
23. 4G services will be activated when a customer on X tops up by €20 (inc. VAT) for the first time and continuous access to the 4G network is not dependent on a minimum top-up amount thereafter. Access to 4G is strictly subject to a customer’s handset 4G capability and 4G network coverage. Connection speeds can vary with local conditions, the number of users in your area, the device you are using, and general internet traffic. 24. 4G will be provisioned within 48 hours of the minimum amount top up, 4G cannot be used when roaming and 4G is for mobile phone data use only.
25. A reminder will be sent via SMS to customers on the Offer towards the end of the 4 weeks offer period to top up to continue to avail of the Offer. Vodafone does not warrant or represent that it shall send such a reminder and it shall not be responsible for any liability incurred by Customers as a result of its failure to do so.
26. Once you sign up to this Offer, you are giving your consent to Vodafone to contact you regarding changes/enhancements to the Offer and updates while you remain signed up to this Offer.

These offers are communicated by Vodafone Retail staff, Vodafone online channels or promotional agency staff and the end dates of the offers are printed on dedicated promotional flyers/vouchers.  Under this Vodafone X “2month’s Free” offer, eligible customers will receive a “2 Month’s Free” offer voucher. Offer eligibility is determined by Vodafone. The offer voucher entitles the voucher holder to two month’s free on Vodafone X (free 2 x 20e top up) when you port to Vodafone X from another mobile network provider within the offer period. To avail of the “2 month’s Free” offer, you must present the offer voucher, along with a valid ID in a Vodafone retail store before the voucher expiry date. Eligibility and voucher expiry date will be stated on the voucher. By signing up to the Spotify Premium content service, you understand and expressly agree that Vodafone is not responsible for the provision of the Spotify service to you. If you do not agree with this term then please do not use the Spotify service.
   17. The Sky Sports Mobile TV (SSMTV) service is an independent third party content service, provided by British Sky Broadcasting Limited. Vodafone is not responsible for and does not accept any liability whatsoever in relation to the provision of the SSMTV service, content within or the use of such content by Vodafone customers. By signing up to the SSMTV content service, you understand and expressly agree that Vodafone is not responsible for the provision of the SSMTV service to you. If you do not agree with this term then please do not use the SSMTV service.
2. Cost of Service
   1. Where the Content Pack is included as part of your applicable Vodafone X offer we supply a virtual Content Pack Pass and the content provider accepts that pass to give you access to your chosen Content Pack for the agreed term within your offer.
   2. If you chose to add an additional charged Content Pack selected as a monthly ‘Add On’ subscription the cost of the Content Pack will be confirmed to you on or before taking out the subscription. We supply a virtual Content pass on a monthly basis for the duration of your subscription and the content provider accepts that pass to give you access to your chosen Content Pack.
   3. The cost of this monthly ‘Add On’ subscription will be deducted from your call credit balance if you are a Pay As You Go Customer. If you do not have sufficient credit in your account then you cannot purchase or avail of the service. Vodafone will try to debit your account with the monthly fee for a period of five days after your monthly subscription date. You will be automatically unsubscribed from the service if you do not have sufficient credit in your account within five days of your monthly renewal date.
3. Access to the Service
   1. If you exceed your Offer data allowance when using the Content Pack you will incur additional internet data charges. If you access the Content Pack outside the Republic of Ireland then you may incur browsing, downloading and other internet data charges at the standard internet data rates for roaming.
   2. The Service is subject to network coverage, mobile equipment capability and the operating system installed on your mobile equipment.
   3. Vodafone cannot guarantee that the Content Pack will be compatible with all smartphones and it is your responsibility to check in store or online for your smartphone's compatibility with the Content Pack that you wish to subscribe to before you purchase the Service.
   4. You acknowledge and accept that if, during the period of the Offer, the content provider terminates their agreement with Vodafone, you may no longer be able to avail of your chosen Content Pack for free on your applicable offer. If this should occur, you accept that Vodafone will continue to provide the Offer package that you have registered for without the Content Pack.
4. Sky Sports Mobile TV Package
   1. Sky Sports Mobile TV Pack 1 contains the following channels; Sky Sports Premier League, Sky Sports Action, Sky Sports Arena, Sky Sports News & Sky News.
   2. If you have the applicable Offer when signing up to the Sky Sports Mobile TV subscription you will get access to the Sky Sports Mobile TV Pack 1 included for the duration of your Offer term.
   3. The Sky Sports Mobile TV Content Pack is for use in the Republic of Ireland and the United Kingdom only.
   4. You are advised to check that your device is compatible with Sky Sports Mobile TV before choosing this content option.
   5. The Sky Sports Mobile TV Content Pack can only be accessed on the device linked to the mobile number that you have registered for the service with. If you change your mobile device then you can continue to use the Content Pack on your new mobile as long as it uses the same mobile number on Vodafone and your new mobile equipment is compatible with the Content Pack.
